Assume It's A Zachar?!

A question on Bava Kamma 11b תוספות ד"ה דקא - Why don't we be מיקל on the 15th day assuming that the שליא was a זכר and then be מחמיר on the 41st day making the same assumption?? Why do we have to be מחמיר on both ends?
