The Rambam [Shmittah 1/4] says that planting a tree in the seventh year is an איסור דרבנן.
Great.
The Gemara [Gittin 53b] says that if one planted a tree on Shabbos accidentally he is NOT penalized while if he planted on the seventh year then he IS penalized. Asked the Gemara: Let's see: הא דאורייתא והא דאורייתא - they are both di-oraisa so why is there is distinction made between them.
Hmmmmmmmm.
How will the Rambam digest that one??
