At last nights tisch, the Rebbe Shlita asked the following question.
What is the halacha if two witnesses testify falsely that a person is חייב מיתה. May he now run away?
3 possibilities:
1] He is חייב to run away and save his life.
2] He is permitted to run away.
3] He is forbidden from running away.
Also - may he cut off the hand of one of the witnesses, thus rendering his חיוב מיתה inapplicable because the gemara says [Sanhedrin 45] that if נקטעה יד העדים פטור - for the Torah requires that the hand of the witnesses carry out the punishment and if they lack a hand there is no punishment. They have the status of a rodeph - don't they?
Maybe the witnesses themselves who do teshuva are obligated to cut off their own hands in order to save this person. Retracting the testimony is NOT an option for כיון שהגיד שוב אינו חוזר ומגיד.
If you have a PROOF, please share it. If you don't - maybe ask around....
PS - I conducted a computer search and found a number of important sources. This is an opportunity to thank my sweet friends who last year contributed to my updated Otzar Hachochma program, thus enhancing the blog להגדיל תורה ולהאדירה. You forgot about it long ago, but I didn't and Hashem CERTAINLY didn't.
