לזכות משה יהודה בן פעשא דינה
The
pasuk says אל פתח אהל מועד יקריב אותו and Rashi explains that we learn from the
word יקריב that we should sacrifice the korban even if
Reuven's Olah became mixed up with Shimon's Olah and we don't know which animal
belongs to whom. We just bring it blindly on behalf of the true owner.
The
mishna in Zevachim [71a] teaches that if korbanos became mixed up, we bring each
one on behalf of the true owner. The gemara [74b] asks how we can bring these
korbanos for we require that the true owners perform semicha [some people don't
know that animals can become rabbis – problem is, we shecht 'em afterwards.
This is actually what happens to some human rabbis too after they receive their
semicha] and we don't know who the true owners are?
The
gemara answers that we are talking about korbanos of women that don't require
semicha.
One
gadol asked based on this gemara why Rashi gave the example of
"Reuven's" korban that was mixed in with "Shimon's" korban
when the gemara is clear that we are talking about women. Ever meet a maidel
named Reveun? [There are not even "Reuvena's" walking around!]
Rav
Genechovski suggested [what some argue is a remote possibility] that maybe
Rashi can say that Reuven and Shimon are עבדים
כנעניים who
are not obligated in semicha.
Also,
maybe we are talking about יורשים and according to R' Yehuda [Temurah 2a] יורשים are
not obligated in Temurah. The reason the gemara wasn't satisfied with the יורשים explanation, explained Tosfos [Gittin 28b] is
because the mishna states כל הזבחים which includes a Korban Chatas and יורשים can't bring a Korban Chatas. But Rashi never
said כל הזבחים so
he can say that we are referring to יורשים and are not including a Korban Chatas.
