There is a machlokes whether a שליח לקבלה says בפני נכתב ובפני נחתם or only a שליח להולכה. Rashi [on the first mishna ד"ה צריך שיאמר] implies that only a שליח להולכה says it but not a שליח לקבלה as the Ran is מדייק [see דף ב מדפי הרי"ף שכתב הר"ן מילתא בטעמא]. Other rishonim argue [such as the Ritva] that a שליח לקבלה says it as well.
The Yeshuos Yaakov [אבה"ע קמ"ב ג] offers a brilliant proof for the shittah of Rashi: The mishna [דף ט] talks about a case where the שליח received a get but couldn't say בפני נכתב [in which case עדים must verify the signatures]. The gemara says that it CAN'T be discussing a case where the שליח became deaf during the course of his שליחות because in such an instance he is not a valid שליח for he lacks דעת. The gemara explains that it must be talking about a case where the שליח brought the get to the woman in Eretz Yisrael and before he managed to say the "phrase that pays" he suddenly became deaf.
Seems like a REALLY remote possiblity. What are the odds??! אוקימתא דחוקה - no? Why did the gemara not say that it is talking about a case where the בעל handed the get to the שליח לקבלה and strictly speaking, the shaliach's job is done. Now he just has the technical job of saying בפ"נ [unlike the שליח להולכה who must remain a valid shaliach until the handing over of the get]. So it can easily be talking about a much more likely case where he received the get and then became deaf over the course of his journey to Eretz Yisrael and before he handed it over he became deaf??
Veist ois that it must be that a שליח לקבלה doesn't have to say בפ"נ [for the reason explained by the Ran] as Rashi holds and that is why the gemara had to settle on such an אוקימתא דחוקה.
