How Many Walls Create A Private Domain?

לזכות אברהם מרדכי בן נעכא גיטל לברכה והצלחה בכל

All right - the last few posts were more psycho-philosophical. Now... m'darf lernen:-) [we must learn].

I have to run in a few minutes so I promise to keep it short [famous last words].

We know that if you have an alleyway [clearly one of my favorite words in the language] that is closed on three sides the law is that you place a לחי [I don't know exact how to say that in English but maybe] - a stick, next to the entrance of the alleyway or a קורה, a beam, across the top. This allows one to carry in this area. On the surface, this area has the absolute status of a רשות היחיד and all that such a category encompasses. As such, if one would throw an object into this alleyway from a רשות הרבים it would be an איסור דאורייתא of הוצאה מרשות לרשות - transferring from one domain to another.

The Rambam [Shabbos 17/9] SHOCKS the world and says that ONLY in the case of where there is a לחי is this true. If there is a קורה then one is NOT transgressing a דאורייתא when transferring an object from a רשות הרבים. This is because the Rambam views a לחי as a bona fide halachic wall and this fourth wall creates a רשות היחיד. However a קורה, while permitting carrying within the area, does NOT constitute a wall and thus if one transfers to this area from a רשות הרבים there is no איסור דאורייתא involved.

Many Rishonim [see the Raavad there] argue with the Rambam and maintain that a רשות היחיד is created by THREE walls [and not four like the Rambam holds].

I really have more to say but I gotta run sweetest friends:-)

Love always,

Me
