Limmud Zchus

The other way of looking at this is that even though they spent four years in an environment so antithetical to Torah, they still care.... And even though they carry around all of the tumah of the world in their pocket, they still daven and learn. That is what Rav Levi Yitzchak of Berditchev would say.

מעשה בצעיר שעזב בתקופת הצנע [תקופה של מצוקה כלכלית] את הארץ ונסע אל קרוביו בחו"ל כפי בקשתם, אף ששם היה משופע בעושר לא חפצה אשתו להישאר באותה מדינה ורצתה לשוב ארצה, ואף כי הוא נטה להישאר בחו"ל פנה לחזון איש ע"י שליח לשאול בדעתו. השליח בא לרבינו שהקשיב לשאלתו כבר ליד הדלת ושאלו האם הפרנסה היתה מצויה לו פה. הלה השיב "הוא הרויח טוב לא יוצא מן הכלל טוב אבל טוב".

המשיך החזון איש ושאלו מה אומרת אשתו והושב היא רוצה לחזור ארצה. אם כן אמר החזו"א שישוב ארצה.

ולפני שנכנס לחדרו הוסיף החזו"א "כשיש בשביל פת לחם, לא עוזבים את הארץ". 

The Real World - Part 2

A person who realizes that the true world is the spiritual world then davens in a completely different way. It is no longer about "getting what you want" out of G-d. He is no longer a big candy machine in the sky who gives you what you want if you ask nicely, say "pretty please" and do so enough times. No longer. Now, just being able to express yourself is sufficient because the soul feels such a powerful need to do so. Having your prayers answered becomes a secondary consideration.

The pasuk says [Tehillim 63/6]

"כמו חלב ודשן תשבע נפשי ושפתי רננות יהלל פי".



[As] with choice foods and fat, my soul will be sated, when my mouth praises with expressions of song.

This can be understood to mean that my soul is satisfied [as choice foods satisfy the body] and fulfilled when my mouth praises Hashem - regardless of whether my prayers are answered. 

מתוך הכרת הגודל הזה, בהוד תיאוריו הנצחיים שאינם פוסקים, מתגדלת התפלה בתכונתה, ומוצאה היא את מטרתה בביטויה, וגילוי חייה. התמלאות המאויים נעשים לה דבר נטפל. כמו חלב ודשן תשבע נפשי ושפתי רננות יהלל פי.

The Real World

Some people think that the "real world" is the concrete physical world while the world of the spirit is an imaginary world. This small mindedness is intellectual poison! These people might keep mitzvos and claim to believe but deep inside they lack recognition that the opposite is true. Going from the concrete, secular world to the world of Torah and mitzvos is an escape from destruction and nothingness to true life. 


בקטנות הדעת מונח ארס פנימי, שנדמה על ידו, שכל הנתקה מן החול אל הקודש היא דחיה מישות אל אפסיות. ואף על פי שההודאה החיצונה מנגדת לזה מצד קבלת האמונה, שמסעדת את כל כושל, גם הנשפל בקטנות, בכל זאת בעצמיותה של ההכרה חסר זה היסוד המאיר, המזהיר את נשמת האדם בתוכיותה, שעל ידו הנשמה טבועה כולה בהכרתה העליונה, שכל הנתקה מן החול אל הקודש היא בריחה מחורבן ואפסיות אל הישוב המילוי והישות הכבירה והאיתנה, אל חיי החיים בעוצם מקוריותם, והזרמת שפעתם ההומיה, מלאת המנוחה והעז.

Here is a proof. As I write, my body is slowly but surely decaying and dying. I think that I am alive but I am a walking, breathing, ticking time bomb that at any second can end. From about 26 years old the aging process begins culminating in a guaranteed death [I am 20 years into the process and according to statistics well past halftime in my life. EXCITING!:-)]. No escape. But the spirit never gets old and last for eternity. 

You buy an apple. Eat is SOON!! It is also slowly rotting. See how ALL of our physical possessions get old and are ultimately rendered useless.

So our world is one that is going toward destruction and decay while the soul and spirit will NEVER age and will last forever. It all depends on the quality of our relationship with Hashem.

How Far Does Free Choice Go? Two Scandals

I heard a Rosh Yeshiva encouraging the boys in his yeshiva to get a filter for their smartphones. He said that he won't force them and gives them free choice but they are strongly encouraged to do so since a yeshiva is a place of kedusha. 

I was wondering if he allows boys to bring live, naked girls into the dorm? Does he give the boys "free choice"?? Probably not - so why does he allow them to bring naked girls on a video screen?

It completely eludes me how any "yeshiva" can call itself that knowing that the boys are contaminating themselves with terrible filth in the dorms [and elsewhere]. But yet - there are many such institutions.

Wonder of wonders.

I was once at a place where boys were watching movies and had full Internet access in the Beis Medrash. And nothing was done [maybe because some of the rabbeim also had their smartphones in the Beis Medrash.]     

To my mind - this is a scandal. 

Sadly, I am no big Baal Tzdaka but if I were, I would [בל"נ] happily donate to yeshivos that insist on basic standards of purity [with a smile and much love and warmth].

On that note I read that at certain universities the graduation ceremonies took place this year on Shavuos so the Orthodox students asked for and were granted an alternative ceremony.

Another wonder. A boy or girl willingly spends four years on a secular college campus which is rampant with sexual promiscuity but then suddenly won't attend a graduation ceremony on Yuntiv - which isn't even assur. If they would ask me I would tell them to better skip the four years and attend the graduation ceremony. I have quite a bit of gray in my beard, am married with adult children, am afraid of G-d and being punished for my sins, and nevertheless would be afraid to spend ONE WEEKEND on a college campus. But these young kids, with their raging hormones, spend years there.

And even pay [quite often] 50k plus-minus to do it.

Another scandal.

I was able to evade the draft during the Vietnam War by hiding - I am not making this up - in my mother's womb.

Thoughts on me...


My very essence is nothing [without the will of Hashem who gives us life]. My feeling of my essence is nothing. Since my very essence is nothing, of course the feeling that I have about it is meaningless. My desire to do good is nothing - since I am nothing. My possibility to carry out good is nothing [since even my desire is nothing]. My actualizing of the good is nothing. My ability to withstand opposing forces that stop me from doing good is nothing.    

In summation - I am one big ZERO!!! Actually - MANY big zeros. 

Sound bad??

I will tell you worse. We all say this EVERY MORNING!!:-) 

Indeed, all that truly exists is G-d and our job is to be a good כלי to carry out His will.

מה אנו, מה חיינו, מה חסדנו, מה צדקנו, מה כחנו, מה גבורתנו



האפסיות של כל נוצר, בהיותו נחשב למציאות בפני עצמו, באה להכרה בששה צדדים, האחד, עצם המהות שהוא אין ואפס, כי אין לשום נברא שום עמדה עצמית כלל, זולת חפץ הבורא המקיים אותו. השני, הרגשת המהות שלו, שאי אפשר כלל שירגיש את מציאותו למציאות מוחלטה, מאחר שהמקור שממנו נובעת הרגשתו זו היא עצם מהותו, והרי הוא דבר שאינו ראוי כלל מצד עצמו לשם מציאות, ואיך תוכל הרגשתו במציאותו, שהיא התאור הראשון למהות של חיים, להיות נחשבת להרגשת מציאות. השלישי, היא אפסיות הרצון להשפיע טוב, כי איך תוכל שאיפה של חסד והטבה להיות מיוסדת במציאות כזאת, שאינה כלל מציאות באמת. הרביעי, בדבר האפשרות לגשם את החפץ הטוב, שזהו דבר הנותן איזו הערכה חשובה להמצוי, ואיך נוכל ליחש איזה ערך לאפשרות היכולת לגשם את הטוב ולהגדירו, בשעה שאפילו השאיפה של ההטבה בעצמה אין לה יסוד קבוע. החמישי, המשכת הגשום והפעל של הטוב, שבודאי אין לה מקום, מאחר שאין מקום אפילו להתחלת המפעל, מפני חוסר הבסיס של המציאות לכל מצוי מצד עצמו, שהכל כלא נחשב זולת אור בורא כל, המופע במציאותו של כל נמצא. והששי הוא העדר היכולת לעמוד נגד כל מהרס המציאות ומחריבה, שאין מקום ליכולת זאת שתצא אל הפעל, מפני כשלון הכח שיש לכל מצוי מצד עצמו. וע"ז אנו אומרים אלו ששת התארים: מה אנו, נגד אפסיות המהות, מה חיינו, נגד אפסיות ההרגשה של המציאות שלנו, מה חסדנו, נגד חוסר הבסיס של השאיפה לטוב, מה צדקנו, נגד חוסר כח המגשם את הטוב, שהוא כח הצדק, לעומת כח החסד, שהוא ענין השאיפה מצד עצמה, מה כחנו, נגד האפשריות של המשכת הטוב, מה גבורתנו נגד האפשריות של העמדה נגד כל העומד להחריב ולהפריע את הטוב ואת ההשפעה הראויה להביא תועלת לברואים, שכולם אינם נחשבים לדברים מבוססים מצד עצמם, ואינם מצויים כ"א מצד כחו של יוצר כל ב"ה, המושפע עליהם ברב חסדו וטובו.

The Chasam Sofer doesn't "get" why belief in the coming of Moshiach is an "עיקר" - a pillar of faith [as the Rambam maintains]. We have to believe in Moshiach just like we have to believe in everything the Torah and Neviim say, but why an "עיקר"?? So he rejects that approach [!!]. What do you think the Rambam would respond? Why is it an עיקר? Some suggest that the complete fulfillment of the Torah - שלימות קיום התורה - will only happen when Moshaich comes. Any other ideas? 

He also doesn't think it matters if there are 3 עיקרים as per Rav Yosef Albo or 13 according to the Rambam [!!].

[I am often struck by the independent thinking of great Rabbis]. 

Rav Hillel says in the gemara that there is no human Moshiach but that HASHEM HIMSELF will redeem us. [See in the brackets above].  If one believes this - is he a kofer? Was R' Hillel a kofer ח"ו?

Note the end of the teshuva. The Chasam Sofer was a Rav in Hungary but was born in Frankfurt and thus signs his teshuvos

אך הערני תלמידי הרב הגדול מוה' מאיר אב"ד דק"ק אונגוואר נ"י בתפלת רב טביומי המוזכרת בשל"ה שער האותיות אות א' דף ס' ע"א שם נאמר עם יושר עיקרם שלש עשרה יע"ש משמע שקבלה קדמוניות מימי רב טביומי שיש י"ג עקרים. אך א"א לי בשום אופן להאמין שיהי' גאולתינו א' מעיקרי הדת ושאם יפול היסוד תפול החומה חלילה ושנאמר אלו הי' ח"ו חטאנו גורמים שיגרש אותנו גירוש עולם וכדס"ל לר"ע בעשרת השבטים שהם נדחים לעולם המפני זה רשאים הם לפרוק עול מלכות השמים או לשנות קוצו של יו"ד אפי' מדברי רבנן חלילה אנחנו לא נעבוד ה' לאכול פרי הארץ ולשבוע מטוב' לעשות רצונך אלקי חפצתי ועכ"פ ועל כל אופן עבדי ד' אנחנו יעשה עמנו כרצונו וחפצו ואין זה עיקר ולא יסוד לבנות עליו שום בנין אך כיון שעיקר יסוד הכל להאמין בתורה ובנביאים ושם נאמר גאולתינו האחרונה בפ' נצבים ובפ' האזינו כמ"ש רמב"ן שם והרבה מזה בדברי נביאים אם כן מי שמפקפק על הגאולה הלז הרי כופר בעיקר האמנת התורה והנביאים.


והנה ר' הלל בפ' חלק צ"ט ע"א אמר אין משיח לישראל פירש"י אלא הקדוש ברוך הוא בעצמו יגאלם בלי שליח ופי' זה מוכרח הוא דאל"ה אדמקשה לי' רב יוסף מעני רוכב על החמור דיש לדחות דקאי על נחמי' כמ"ש רמב"ן סוף פי' שיר השירים ולא דחאו מדברי זכרי' שיצאו מים חיים מבית ה' וראיה זו כ' הרא"בע סוף זכרי' ע"ש אע"כ מזה אין ראיה דודאי גם לר' הלל יש גאולה אלא שאין משיח מלך וגם בזה לית הלכתא כוותי' והאומר אין משיח וקים לי' כרבי הלל הרי הוא כופר בכלל התורה דכיילי אחרי רבים להטות כיון שרבו עליו חכמי ישראל ואמרו דלא כוותי' שוב אין אדם ראוי' להמשך אחריו כמו ע"ד משל במקומו של ר"א הי' כורתים עצים לעשות פחמין לעשות ברזל לצורך מילה ואחר דאיפסקא הלכתא ע"פ רבי' מחכמי ישראל דלא כוותי' העושה כן בשבת בעדים והתרא' סקול יסקל ולא מצי למימר קים לי כר"א. והא דתני' במס' עדיות למה נישנו דברי היחיד ע"ש מילתא אחריתי כמובן ואין להאריך ועכ"פ הגאולה וביאת המשיח איננה עיקר אבל מי שאינו מודה בו כופר בעיקר של האמנת התורה ודברי נביאים.
ויש לי לעורר בדבר אחד הנה אין לנו בכל התורה שום דבר שאין אנחנו בעצמנו עידי ראיה חוץ מפ' בלעם כי כל מופת מצרים ומדבר את הכל ראו עינינו ונעשה לפני ס' רבוא ולא נשאר א' מכל ישראל בחוץ שלא ראה חוץ למ"ד יתרו אחר מתן תורה בא נשארו בני משה מבחוץ זולת זה לא נשאר אחד שלא ראה בעיניו אין האבות מנחילים שקר לבניהם וה"ל כאלו ראינו בעינינו ואפילו חידוש עולם ומעשה נחש בגן עדן והמבול והפלגה כבר כ' רמב"ן בס' דרשות הרמב"ן הרי אדה"ר אדם הראשון ראה עצמו יחידי בלי אב ואם ומעשה ג"ע וגירושו והוא דיבר פנים אל פנים עם שם בן נח רבו של יעקב אבינו ע"ה כי בן חמשים הי' יעקב כשמת שם וקיבל ממנו כל הנ"ל עם מעשה מבול והפלגה והוא סיפר לבניו ועמרם שמע מלוי ואמרו לבניו משה ואהרן וכל הדור ההוא קבלו כן מאבותיהם ובכל הדורות כל הנעשה לזקן זקנים הרי הוא כאלו נעשה בפניהם ממש וא"א להכחיש זהו במעשיות וספורי תורה.

ואמנם כל סידורי מצות נ"ל כשגעון מי שיאמר שבא' מהדורות קם א' והמציא להניח תפילין ויצא בקרן א' על מצחו והטעה העולם לומר זהו טוטפת האמור בקרא הלא ירגמוהו העם ויאמרו זה לא שמענו ולא ראינו מאבותינו מיום עמדנו על הר סיני ועמנו משה רבינו עליו השלום ואחריו יהושע בן נון וזקנים ונביאים מי ימלא לבו לחדש דבר וכן בענין סוכה וד' מינים וכל מעשה קרבנות מי יכול לשנות הדבר בענין הנהוג בכל יום ויום לפני זקנים ונביאים אם לא כך ראינו בעינינו ממרע"ה ותלמידיו ותלמידי תלמידיו עד היום הזה ויסכר פי דוברי שקר הקראים הרעים מ"ש שאירע בימי שמעון בן שטח ויהודה בן טבאי תמק לשונם בחכם כלה ענן וילך יורד שאול לא יעלה.

נחזור להנ"ל כל התורה כולה ראינו בעינינו חוץ מפ' בלעם מי הגיד לנו מה הי' בין מלך מואב ובין קוסם אחד בלעם שבא אליו אל ארצו ולמה בא ומי הביאו ומי ידע שבנה מזבחות ושרצה לקלל ונהפך לברכה מי בא בסודם וישראל הי' שרוים במדבר ואם הם עמדו בארץ מואב בראש הפסגה וראו למטה אל המדבר למרחוק מאין ידעו יושבי מדבר שמביטים עליהם מראש ההר הזה ושמנחשים עליהם ואפי' מרע"ה לא ידע ורק מפה הקדוש ברוך הוא ית"ש נכתבו הדברים והנביא צווח זכר נא מה יעץ בלק וגו' והנה המאמין בכל התורה ובמצותיה רק מסתפק בפ' בלעם הרי הוא כופר בה' אלקינו ה' אחד ולא יאמר אדם שפ' בלעם היא עיקר מעיקרי התורה שבנו עליו בנין ומ"מ הכופר בה כופר בעיקר וה"ה ומכ"ש בגאולה אחרונה המפורשת מפי ה' למרע"ה אם יהי' נדחך בקצה השמים וגו' וכפר אדמתו עמו וכיוצא בו. - ה' הטוב והמטיב ייטיב לנו ויורנו מארחותיו, ונלכה בדרכיו' ונהי' ממבורכיו, לשמור תורותיו וחוקותיו, נעלה לציון ברננים ודבר אלקינו נשמע פנים אל פנים. פ"ב כאור בקר ליום ג' יוד למב"י תקצ"ול.

The Source Of the Mitzva To Believe In Bias Moshaich

What is the source in Halacha that we must believe in the coming of Moshiach? 

The ספר מצות הקטן known as the סמ"ק says that it is derived from the mitzvah of אנכי ה' אלקיך because the true revelation of Hashem will be when Moshiach comes. 

The Rambam proves from the fact that the Torah commands us to separate certain cities as ערי מקלט after Moshiach comes that Moshiach will come. The Lubavitcher Rebbe זי"ע says that according to the Rambam the mitzva to believe in the coming of Moshiach is a detail and outgrowth of the mitzvah of ערי מקלט.

Rebbe Tzadok Hakohen works hard to find a source.... 

ר' צדוק הכהן מלובלין - קונטרס ספר הזכרונות מצוה שלישית
ומצאתי בפסיקתא זוטרתי (פרשת ואתחנן דף ס"ז עמוד ד') על פסוק זה ["כי שאל נא לימים הראשונים אשר היו לפניך"], כתב שהוא מצוה על ישראל להבין ולהשכיל שהקדוש ברוך הוא יכול להושיעם ולקבצם מן האומות, כשם שעשה לאבותינו במצרים וכו', עיין שם:
הנה כתב בביאור שמקרא זה מצוה מיוחדת, אלא שפירשה לענין אחר. אבל אנו אין לנו בפירוש המקראות בציווי התורה אלא המקובל בידינו מפי רבותינו ז"ל, ואפילו יהיה נגד המשמעות הפשוט. וכבר זכרנו מדברי חז"ל בחגיגה שפירשו משמעות המקרא על החקירה במעשה בראשית:
והמצוה שזכר אם עיקר כוונתה על האמונה בביאת משיח וגאולה העתידה שעשאו רמב"ם מעיקרי התורה אבל לא מנה בו מצוה מיוחדת, הנה במקרא זה לא נמצא זכר מזה, ואין טעם לסמכו על מקרא זה כלל:
ואם יהיה אמונה זו מצוה מיוחדת, נראה לי שיש למנותה מלשון הכתוב סוף פרשת האזינו אחר השירה א': שימו לבבכם לכל הדברים אשר אנכי מעיד בכם היום וגו' (דברים ל"ב, מ"ו). וזה מצות עשה לשום לב לעדות השירה, ושימת לב זה הוא מה שהעיד לנו השם יתברך מכל עניני הגליות והצרות העוברות עלינו, ושסוף הכל דם עבדיו יקום ונקם ישוב לצריו, והוא בביאת המשיח. וזה מצוה מבוארת על אמונה זו:
ומיהו יראה שאין עיקרה על דבר זה לבד, רק על כל עניני השירה כולה, וזה טעם לשון שימת לב שיתבונן איך כל הכתוב בשירה מתקיים והולך, והוא ההתבוננות גם כן בעניני הצרות והגליות איך דבר ה' יקום, ובזה יתחזק באמונתו ועשיית מצוותיו:
וכן מבוארת ענין מצוה זו על הדרך הזה למעלה בפרשת וילך, שנאמר ועתה כתבו וגו' ולמדה את בני ישראל שימה בפיהם, למען תהיה וגו' והיה כי תמצאן אותו וגו' וענתה השירה הזאת לפניו לעד וגו', כי ידעתי את יצרו וגו' (שם ל"א, י"ט - כ"א). והנה מאמר כתבו נמנה אצל מוני המצוות מצות עשה מיוחדת על כתיבת ספר תורה. אבל מה שאמר ולמדה וגו', הוא ציווי מיוחד לא נמנה אצלם לא ידעתי לו טעם:
וכפי הנראה היה ראוי למנות זה מצוה מיוחדת על לימוד שירה זו לכל אחד מישראל, אלא לפי שלא נקבע לו זמן אפשר שיהיה די בפעם אחד כל ימי חייו, ועל כל פנים די בקריאת הפרשה פעם אחת בשנה כתיקון חכמים. אבל על כל פנים יהיה קריאת פרשה זו מצות עשה דאורייתא:
והנה בה מבואר שיהיה לעד בעת הצרות, שכבר ידע השם יתברך הכל קודם ושהכל בהשגחתו, ויתחזק בזה באמונת השם יתברך. והמצוה דשם הוא על הלימוד בפה ולשום בפיהם, וחזר וציוה על השימה בלב וההתבוננות בענין השירה איך כל עניניה נתקיימו הכל. אבל מכל מקום בכלל המצוה גם כן האמונה בקיום כולה, ויהיה המצוה על דרך שימת לב וההבנה מתוך מה שכבר נתקיים ממנה שכך עתידה להתקיים כולה. והוא על הדרך שביאר בעל הפסיקתא להאמין בזה על דרך ההשכל וההבנה:
ושם זכר גם כן, זכור ימות עולם וגו', שאל אביך ויגדך וגו' (דברים ל"ב, ז' - י'), ימצאהו בארץ מדבר וגו', מן הישועות הקודמות והשגחתו יתברך מאז, שמזה נאמין גם כן בישועה העתידה:
ויראה שמאמר זכור ימות וגו' שבא בלשון ציווי יהיה מצוה מיוחדת על הענין הזה, להתבונן בחסדי השם יתברך עמנו וימות עולם ובכל דור ודור:
וגם המצוה הזו אי אפשר לכללה במאמר כי שאל נא וגו', שהרי לא זכר שם אלא מתן תורה ויציאת מצרים. ועל זכירת שתי ענינים הללו באו שתי מצוות מיוחדות יתבארו במקומם:
ובשערי תשובה לרבינו יונה (שער ג' סימן י"ז) כתב שזכרון חסדיו וההתבונן בהם הוא מצות עשה, שנאמר (דברים ח', ב') וזכרת את כל הדרך וגו', ואמר (פסוק ה') וידעת עם לבבך כי כאשר ייסר וגו'. והנה מאמר וידעת וגו', מנאוהו סמ"ג וסמ"ק מצות עשה לצדק דיניו יתברך וכמו שיתבאר בסימן. ומאמר וזכרת וגו' לא נזכר בו אלא ענין המן, וסיים בו למען הודיעך כי לא על הלחם לבדו וגו'. נראה שעיקר זכירה זו היא גם כן על ענין זה לדעת שהשם יתברך הוא הזן ומפרנס, וזה מצוה בפני עצמה:

ומצינו במקום אחר מצוה גם כן על ידיעת יסוריו יתברך לעוברי רצונו בדורות הקודמים, שנאמר (דברים י"א, ב') וידעתם היום וגו' את מוסר ה' וגו' וזרועו הנטויה וגו', אשר עשה בתוך מצרים וגו', ואשר עשה לחיל מצרים וגו', ואשר עשה לכם וגו', ואשר עשה לדתן ולאבירם וגו':
ומיהו אפשר שזה מצוה לאותו דור בלבד, כמשמעות לשון תחילת המקרא וידעתם היום כי לא את בניכם וגו'. וכן מה שסיים אחרי כן כי עיניכם הרואות וגו' למען תחזקו ובאתם וגו'. ולדורות אפשר יהיה זה בכלל מצות שימת לב אל דברי השירה, ששם נזכר עונשי השם יתברך לעוברי רצונו:
והנכון שזה בכלל מצות אמונת השכר ועונש שזכרנו בסימן א', שהיא מצוה מיוחדת לדעתי מקרא דוידעת וגו' ומשלם לשונאיו וגו'. ואף על פי שלא פירש שם דרך ההתבוננות מן הקודם ומה שכבר קרה, אמנם מצות זכור וגו' אינה בהתבוננות השכר לעושי מצוותיו, רק בהתבוננות חסדיו עם ישראל ביחוד שבחר בהם לו לחלקו והרבה להיטיב עמהם בפרט. וזה ההתבוננות מצוה מיוחדת במאמר זה, ואין לו ענין למאמר שאל נא וגו' שלא נזכר שם מזה, וכמו שנתבאר:
והנה נתגלגלו בהמשך הדברים כאן זכרון כמה מצוות שלא מנאם הרמב"ם, ובא זכרונם כאן אגב גררא. ונראה ששתי מצוות הללו, של זכירת חסדיו יתברך עמנו, ואמונה בלב לגאולה העתידה, אנו יוצאים במה שאנו מזכירים דברים הללו בברכת קריאת שמע שלאחריה ביום ובלילה, ובתפילת שמונה עשרה. ואנשי כנסת הגדולה שתקנו לנו תפלות וברכות בחכמה ותבונה, סידרו מעשיהם להזכיר בכלל דבריהם כל עיקרי האמונה והידיעות שציותה תורה על האדם לדעת ולהאמין ולזכרם, ובזה יצא ידי חובת הרבה מצוות דאורייתא, ובלבד שיהיו פיו ולבו שוין בכוונת מה שהוא אומר:
ועיין אוהב משפט לרשב"ץ [בפרקיו שהקדים פרק י'], כתב כי במצות היחוד הוא להאמין כי אז יהפוך אל עמים שפה ברורה לקרוא כולם בשם ה' לעבדו שכם אחד, ואז יהיה ה' אחד ושמו אחד. ועיין שם על פי דרכו שאין ראוי למנות עיקר האמונה, נראה שזהו כוונת מצות היחוד, וזהו מה שהכריחו לכך עיין שם. ואין זה נכון, ולשון הרמב"ם אינו כן, ואינו במשמע לשון הכתוב דשמע ישראל וגו' כלל, דפשוטו על היחוד בהווה לא בעתיד, וכאמור:
ואולי לרמב"ם וסייעתו יהיה זה מכלל מצות אנכי, שענינו אמונת ההשגחה וכמו שכתבתי בסימן א', שדאגת הפרנסה הוא מקטני אמנה, שגם זה מכלל מצות אמונת השגחתו. אך לבעל הלכות גדולות ורמב"ן ודאי ראוי למנות זה מצוה בפני עצמה. וגם לרמב"ם אנכי הוא ציווי האמונה בכלל וזה פרטית, וגם אין המצוה האמונה רק הזכירה ממה שהיה במדבר שזה ענין פרטי:
ולא ידעתי למה לא מנו זה מצות עשה כפשטיה, ודחוק לפרשו ציווי לאותו דור לבד, על דרך שנסתפק הרמב"ן בהוספותיו למצוות עשין מצוה ז' על זכירת הקצפת דור המדבר, שאינו במשמע מן המקראות שלפניו ושלאחריו בציווי שמירת כל המצוות שהם ציוויים כוללים. וגם מן הספק אין לנו לפטור ממצות עשה:
וראוי לשים על לב זכירת מצוה זו, אלא שהואיל ולא נקבע לה זמן אפשר יוצאים בקריאת פרשת המן בתורה פעם אחת בשנה, ובלבד שישים לב לדעת מזה כי לא על הלחם וגו', ושרק השם יתברך הוא המחיה את האדם:
ובסימן א' בארנו שזה מצות אמונת הבטחון בו יתברך, אך מצות התבוננות חסדיו דרך כלל הוא במאמר זכור וגו', שציוה לזכור חסדיו יתברך בכל דור ודור מימות עולם, ולשאול ולחקור על זה מהאבות, מחסדים שנעשו עמהם:

Two Resolutions To Perplexing Rambams

With regard to the question presented in this post:

Possibly the most famous answer is that of the Ohr Sameach: When the goy is threatening his life unles he does the aveirah, the סיבת האונס is the aveirah. So if he commits the aveirah, he is not punished because it was done out of compulsion. But where he is sick, there is nobody compelling him to do the aveirah. The sickness is one thing and the aveirah he does to save himself is another. So the aveirah is not considered as having been done באונס. In his words זצ"ל:

כענין שאמרו באונסין כך אמרו בחלאים כו' ומתרפאין בכל איסורין שבתורה במקום סכנה חוץ מעכו"ם וגילוי עריות כו' אין מתרפאין מהן. ואם עבר ונתרפא עונשין אותו ב"ד עונש הראוי לו הא ודאי דלא דמי למה שפסק בהלכה ד' דבמקום אונס אף במידי דיהרג ואל יעבור אם עבר אין עונשין אותו דאונס רחמנא פטריה, דסברא הוא, דוקא אם אונסין אותו שיהרוג את פלוני, או לגלות עריות, [באופן שהוא מקושה מכבר] דאינו עושה מרצונו רק ברצון אחרים שרוצה שיהרוג את פלוני, ואם לאו יהרג על דבר שאינו הורג פלוני. א"כ מסיבת מי באה הריגתו אם יהרגנו המאנסו, מסיבת שאינו רוצה להרוג פלוני, אבל כאן החולי הבאה אליו הוא בלא סיבת שום דבר, רק יכול להציל את עצמו בדם פלוני או בע"ז פלונית א"כ זה מיקרי חפץ גמור מרצונו בחייו, וכמו שכל רוצח רוצה לשפוך חמתו לראות נקם, ולכן כאן חייב באם נתרפא, בכל עונשי ב"ד, וכיו"ב תמצא להפוסקים בחו"מ סימן שפ"ח בש"ך ס"ק כ"ב, דאם אנסוהו להראות שלו, והראה של חבירו חייב, ואם אנסוהו להראות של חבירו באונס ממון, היינו שאם לא יראה יטלו ממנו ממונו, פטור והיינו מטעם הנ"ל, דכאן דמציל עצמו בממון חבירו חייב, אבל באונסין אותו על ממון פלוני, באונס ממונו הלא מסיבת מה באה האונס, הלא אין חפץ האנס בממונו, רק בשביל שלא יראה לו ממון חבירו רוצה לגוזלו לכן פטור ודו"ק. אבל מנין יצא לרבינו זה, נראה דמקורו מירושלמי פרק אין מעמידין ואין דוחין נפש מפני נפש, לא סוף דבר כו' נכרי בנכרי נכרי בישראל חייב, ישראל בנכרי פטור, וכפי הנראה קאי על מה דאמר בסמוך שאין מתרפאין על שפיכת דמים, וע"ז קאמר דנכרי בנכרי חייב, אף אם הרג איש לרפואתו אבל ישראל בנכרי פטור כדינו, ואם ישראל נתרפא ברציחת ישראל ג"כ חייב, וקמ"ל רבותא דאף נכרי חייב, [אע"ג דאינו מצווה על קה"ש] או משום שבן נח נהרג אף אם אומר מותר להתרפא ברציחה כדינו, יהיה איך שיהיה מפורש דבנתרפא עונשין אותו עונש הראוי לו ודו"ק.

Rebbi Akiva Eiger [in his notes on the Rambam cited in the Ohr Avraham] says that we need a special heter to heal the sick. How are we allowed to tamper with G-d's will? If G-d made the guy sick He obviously WANTS him that way. So what right do we have to try to heal a person?? The answer is ורפא ירפא - The pasuk teaches that doctors were given permission to heal. This permission is revoked in cases where the three biggies [ג"ע שפיכות דמים וע"ז] are involved and thus we return to the original איסורים of יהרג ואל יעבור.

Learning To Exert Yourself In Learning

My question is  - How do we take a generation of children who are being raised on the Internet, twitter, Instagram, Facebook etc. etc. and plant them firmly in the Beis Medrash, where are no graphics, no instant gratification, no constant amusement, no games etc. etc. How can you get people today to go through a 20 page simman on a complicated, deep sugya or halachic question?

This week was the yahrtzeit of HaGaon HaGadol Bi-yoseir HaRav Dovid Yitzchak Mann ztz"l who passed away just a few years ago. I am not one to judge but in my mind he was a least a cut above just about every Rosh Yeshiva or Rav in our time and many many cuts above most of them. It is just beyond human belief what an incredible lamdan and talmid chochom he was. There are many people who are far more famous than he [the proof is that you probably never heard of him until I just mentioned his name...] who weren't near his level in learning. OF COURSE we respect and revere every person who learns Torah and is a talmid chochom and Baruch Hashem our generation has been blessed with many great talmidei chachomim but Rav Mann was in a league of his own. But his sefarim are not popular. Why not? They are SOOO GOOOODD. Yes, but they are loooonnngggg and compleeeeeex and deeeepppp. Just getting through all of his question on the gemara or Rambam is an accomplishment. And then he answers all 14 questions - while taking care of another 11 on the way. 

I once received an email from a friend, an avreich in kollel, imploring me to stop sending my weekly parsha sheet. Too long. Too complicated. If I have a short, quick, easy vort I should send it to him. He is a good person - much better than me. He learns Torah - all the time.. But he - like all of us - are products of this generation and that is a challenge we must overcome. [I stopped sending to him and also stopped sending to all of those who didn't want to hurt my feelings by flat out telling me that they never open it up and I am wasting my time sending it to them]. That is not to say that what I print every week is the gold standard. There is much better out there. I am just giving an example of how hard it is for people to expend extended mental efforts in learning.   

First we have to understand the myriad of ways our culture and society affect us and then devise strategies to transcend it. 

What yeshivos and kollelim do today to get people to learn with diligence is to give incentive$.  

People who need it - need it. But lishmah it is not...

People today like to buy the various glossy "religious" magazines and read them instead of learning. There are definitely worse things to read. It is not the end of the world [neither is the fact that they don't print pictures of women which for some has replaced world hunger and disease as our greatest problem in the eyes of numerous bloggers and "post"ers]. They are attractive - graphics, many many color pictures, interesting ads, stories etc. etc. but require almost no mental exertion. Like I said, not the end of the world. People need down time to chill. But it is not like after "chilling" people get up and go to the Beis Medrash and have a seder to learn through the entire Ktzos Hachoshen cover to cover. After chillin' with the mag. - they chill in other ways....

Anyway - a clarion call to learn Torah with toil and diligence!!!

Lost In Translation

People wonder - How can we say we are right when there are over two billion Christians and only about 13 million of us? 

There are MANY MANY answers to this question. Here is a thought:

The two basic texts of their cannon are the "Old Testament" and the "New Testament". The "Old Testament" is written in Hebrew while the New is written in Greek. 

How many Christians can read these texts in the original? Faaaaarrrrrr less than one percent. A fraction of a fraction of a fraction of a fraction of a fraction of a percent. Understand the Tanach in the original? They don't even know the aleph beis!!

Everybody knows that when reading a translation, the original is ALWAYS corrupted. Every language has its own rhythms, meanings, concepts etc. etc. which CANNOT be translated into any other language.

There is an old story of the Yid who translated Shakespeare into Yiddish and wrote on the cover - . שייקספיר - איבערגעזעסט און פארבעסערט
"Shakespeare - Translated and improved." Hardly:-).  

Let us take one word we have been discussing in recent shiurim. ויכולו as inויכולו השמים והארץ וכל צבאם. What does the word ויכולו mean? It can mean to "end", it can mean to "destroy", it relates to the word כלי - utensil, and כלי - amount, and to כלות as in כלות נפש - yearning. So what does it mean here and how do all of the meanings relate?

Or take the first word in the Torah - בראשית. It is simply translated "In the beginning". But the word used is בראשית which when scrambled comes out  ירא בשת and ירא שבת and אש ברית and ברא שית [created 6] and SOOOO MUCH MORE which has been expounded from this word. How much Torah has been said just from the fact that the Torah started with a Beis?!! All they have is a relatively quite pathetic "In the beginning".

Moreover, they lack the oral law - תורה שבעל פה. So what do they make of it when the Torah says that we must keep Shabbos. What is Shabbos? The Torah never tells us.... The Torah says to slaughter and animal כאשר ציויתי - as I commanded. Where? To whom? Only WE have the answer to that question.

Or in this weeks parsha - Miraim spoke about Moshe taking a black woman - אשה כושית. What did she say? NO indication in the text. Next thing you know-  she has tzaraas. What did she say? Only those who are privy to תורה שבעל פה know the answer to that question. Everyone else is in the dark [in the "black?"].  

My POINT is that - there might be 2 billion of them but most of them don't have the foggiest idea what their very own primary texts are saying.  

As for us - GET TO KNOW OUR TEXTS!!! Thank you HaRav HaGaon R' Artscroll Shlita but we should be meeting our texts directly and not with a shadchan at every date who tells us what the "girl" is saying without actually hearing it for ourselves. So much is lost in translation. It is not for naught that three days of darkness came down to the world when the Torah was translated into Greek and it was as bad [in the words of Chazal] as the day THE LUCHOS WERE SHATTERED!!!

I don't want to have a wife who only speaks Chinese and we need a translator to communicate. I want to hear things directly from her. The same from the Torah. Become fluent [if you are not already] in Hebrew and Aramiac!!:-).

The Prophecy Of Eldad And Meidad

לזכות משה יהודה בן פעשא דינה 

Eldad and Meidad prophesied in the camp. What was their prophecy? That Moshe is going to die and Yehoshua is going to bring us into Eretz Yisrael. That means that we are not on the level to go in with Moshe because that would entail living on a completely spiritual level. Since the Jews complained and wanted real food and not the spiritual  מן ,  that proved that they were not ready for a Moshe-esque entry into E.Y. 

According to a second opinion they prophesied about the war of Gog and Magog. The impurity of Gog and Magog is פריקת עול - throwing off G-d's yoke. By asking for regular food, they rejected the pure angelic מן and put themselves in the world of the mixture of good and bad. That is a world of פריקת עול and thus Gog and Magog.

וממוצא הדברים נשמע שבאם לא היו ישראל מקלקלים מעשיהם במדבר והיו באים לתיקון הגמור כמו אדה"ר קודם החטא הי' גופם נמי נעשה ספירי, ובהכרח שגם א"י היתה מתעלה אז והיתה יוצאת מכלל ארץ חומרית לרוחנית כמו הג"ע, ואז היתה א"י ראוי' גם למשה וכמו שיהי' לעתיד אחר התיקון הגמור שאז אחר ההזדככות תהי' ראוי' גם למשה, אבל מאחר שהתאוו למאכל גס ולא נזדכך גופם ונשארו בכתנות עור, וכ"כ א"י צריכה להיות בגשמיות כדי שתהי' נאותה למושב בנ"י שוב הוא גרעון למשה ליכנס שמה. וזה שהתנבאו עתה דוקא משה מת כו' לעורר לבב בנ"י בתשובה בהודיעם מה שאבדו.

I would like to thank Hashem that we can hold it in!!

Thank you Hashem!!! Imagine if we couldn't hold it in? If it just came out randomly and unexpectedly. The entire street would be one big, disgusting, filthy bathroom. We could never learn Torah in a Beis Medrash because at any minute people would be going. The whole world would be filthy. We go on an airplane and there is urine and feces everywhere. We go to work and there is urine and feces everywhere. Our bedroom is constantly being sullied with smelly yellow liquid and dark brown solid mass. YICCCCCHHHHHH!!! Everywhere. We wake up in the morning and we find ourselves full of .... Unbearable.

You are on a date - and right in the middle s/he/you go. Right there.  

So Hashem did us a HUUUUUGE chesed and gave us the capacity [from about age 2 with some help from Mommy] to hold it in and release it [to our great relief!!] at the right time in the right place. [And THANK YOU HASHEM for a plumbing system. And THANK YOU Arab workers for installing it:-)].  

Ever think of that? הודו לה' כי טוב כי לעולם חסדו!!

Another holding it in: People can hold in their thoughts and not just blurt out whatever they think. THANK G-D!! Imagine everybody would know what we are thinking at all times? EMBARRASSING!!! Imagine we would know what other people think of us?! We wouldn't want to know....  

So thank you Hashem for the ability to keep our thoughts private.

PROTECTION FROM THE POWERS OF EVIL

The powers of evil [חיצונים] can't touch what is beneath them. So they can't damage the hadlakas menorah which is beneath ten tefachim. They also can't damage Shabbos when all of our gashmiyus is ruchniyus - even our eating. The powers of evil only have power when there is something impure involved. That is why we must be careful not to be arrogant when we are the beneficiaries of Hashem's bounty in order that the powers of evil don't touch it.

והקשה הרמב"ן ז"ל למה לא נחמו בקטורת ובשאר עבודות, גם הלא הדלקת הנרות בטלה עם שאר עבודות בזמן הגלות. ותירץ שזה רומז להדלקת נרות חנוכה שקיימת לעולם, ע"ש. ונראה דהנה כ"ק אבי אדומו"ר זצללה"ה אמר שעבודת הלויים מלמטה למעלה ועבודת הכהנים מלמעלה למטה, ומחמת זה היתה עבודת הכהנים בחשאי, ועבודת הלויים בקול, עכלה"ק.

והתלהבות ושיר הם דביקות מלמטה למעלה, וזו היתה טענתו של אהרן, היינו שהוא הי' הנשיא של שבט לוי היתה צריכה להיות לו עבודת שבטו ג"כ כמו שהי' לכל נשיא שבט, ונחמו השי"ת בנרות היינו מלמטה למעלה, כמו שפירש"י בהעלותך שתהי' השלהבת עולה מאלי', היינו ההתלהבות להשי"ת מלמטה למעלה, וזוהי עבודת הלויים, וזהו שאמרו ז"ל (יומא כ"ד ב) הדלקה לאו עבודה היא מחמת שהיא אינה עבודת כהנים [ונראה שמחמת שעבודת הכהנים היתה מלמעלה למטה היתה צריכה להיות בחשאי, ותוך המקדש, ותוך החומה, וכבגמ' (שם מ"ד א) יבוא דבר שבחשאי ויכפר כו']. ונוכל לומר שזהו תירוץ הרמב"ן ז"ל שרומז על נ"ח. והענין שזה שבטלה עבודת בהמ"ק בגלות, כי כל גלות הוא לשון גילוי דאתגליא מה דאתכסיא, ויש שליטת החיצונים ח"ו, ומחמת זה היתה צריכה להיות העבודה בבהמ"ק ובתוך החומה וכמ"ש (תהלים קכ"ה) ירושלים הרים סביב לה, והיינו שלא תהי' בה שליטת החיצונים ח"ו, אבל בגלות מחמת החשש הנ"ל בטלה עבודה, ועבודת כהנים היתה למשוך השפעה מלמעלה למטה, וזו איננה יכולה להיות בגלות כדי שהחיצונים לא יקבלו ח"ו ההשפעה, אבל עבודת הלויים שהיא התלהבות ודביקות מלמטה למעלה יכולה להיות בגלות ג"כ, והדלקת הנרות היא ג"כ מלמטה למעלה וזו יכולה להיות בגלות כנ"ל, ואין לחוש לשליטת החיצונים, ואדרבה היא פרסומי ניסא ולמטה מעשרה דוקא שהיא רה"ר, ואין רה"ר תופסת אלא עד עשרה, היינו מפני שאין לחוש לשליטת החיצונים, וזהו שא"ל הקדוש ברוך הוא שלך קיימת היינו נ"ח כתירוץ הרמב"ן ז"ל, ולזה ההלכה (שבת כ"ג א) הדלקה עושה מצוה ולא הנחה, היינו כי לא יכלו חכמז"ל לתקן מצות נ"ח בגלות נגד הנחת השמן והפתילות במנורה, שזו היתה [מלמעלה למטה ששמן הוא חכמה ושבעה קני המנורה שבע מדות כנודע] עבודת הכהנים שפסולה בזר, וזה א"א להיות בגלות, רק הדלקה שהיא לאו עבודה זו יכולה להיות בגלות, ומשום זה הדלקה עושה מצוה, והבן. ולפי"ז ניחא מאמר המדרש שנחמו השי"ת ג"כ בברכת כהנים, היינו מפני שברכת כהנים יכולה להיות ג"כ בגלות, שבזה ג"כ אין שליטה לחיצונים כמ"ש (שה"ש ג') ששים גבורים סביב לה, וזוהי ברכת כהנים שיש בה ס' אותיות:

ובזה נוכל להבין היאך יכולה להיות שבת בגלות, הלא שבת היא מלמעלה למטה ג"כ וכולהון מתעטרין בנשמתין חדתין, אך מחמת שבשבת אין שום שליטת החיצונים כבזוה"ק כולהון ערקין וכו' ושבת היא כולה קודש, ואפי' כל תענוגי שבת ואכילה ושתי' הם כולם מצוה, ובכתבי האריז"ל שמאכל שבת אינו מגשם, ע"כ היא קודש ואין בה שליטת החיצונים, ומחמת זה יכולה להיות בגלות:
והנה כמו שבכלל כן בפרט, שכל איש ואיש צריך להיות זהיר בכל שפע הבאה לו מלמעלה שבל יינקו ממנו החיצונים, היינו שלא יקח אותו לחומריות להתגשם יותר כאמרם ז"ל (קידושין פ"א א) סקבא דשתא ריגלא, ושלא תהי' לו גאות מהשפע שהשיג הן משפע של גשמיות הן משפע של רוחניות. וזהו מאמר הר"ר בונם זצללה"ה על הכתוב (דברים כ"ח) ובאו עליך כל הברכות האלה והשיגוך, שישיגו אותך בלי שום השתנות והתנשאות ח"ו [אזוי ווי דו ביסט] שלא יהי' מקום לחיצונים ח"ו, וד"ל:

How To Attain The Bracha Of Shabbos

We have to realize how far we are from the Kedusha of Shabbos and be embarrassed [שבת אותיות בשת] and in THAT zchus we can receive Shabbos and be a receptacle for all of the amazing blessings that come from Shabbos which is the SOURCE of all bracha!

A huuuuuge chizzuk from the Shem Mi-shmuel based on the Besh"t [who is the BEST!]! Hashem distances himself a bit from the Jews in order that they should learn to make it on their own like a parent who is teaching his toddler to walk. At times he will fall. That is what happened in the desert.

The same happens in our lives. Sometimes Hashem distances Himself a bit on order that we should learn to walk on our own two feet. At times we will fall but that is part of the learning process!!!

Is One Punished For An Aveirah Done Out Of אונס? No - And Then Yes!

The Rambam writes [Yesodei Hatorah 5/4]:

כל מי שנאמר בו יעבור ואל יהרג ונהרג ולא עבר הרי זה מתחייב בנפשו. וכל מי שנאמר בו יהרג ואל יעבור ונהרג ולא עבר הרי זה קידש את השם. ואם היה בעשרה מישראל הרי זה קידש את השם ברבים כדניאל חנניה מישאל ועזריה ורבי עקיבא וחביריו. ואלו הן הרוגי מלכות שאין מעלה על מעלתן. ועליהן נאמר כי עליך הורגנו כל היום נחשבנו כצאן טבחה. ועליהם נאמר אספו לי חסידי כורתי בריתי עלי זבח. וכל מי שנאמר בו יהרג ואל יעבור ועבר ולא נהרג הרי זה מחלל את השם. ואם היה בעשרה מישראל הרי זה חילל את השם ברבים ובטל מצות עשה שהיא קידוש השם ועבר על מצות לא תעשה שהיא חלול השם. ואעפ"כ מפני שעבר באונס אין מלקין אותו ואין צריך לומר שאין ממיתין אותו בית דין אפילו הרג באונס. שאין מלקין וממיתין אלא לעובר ברצונו ובעדים והתראה שנאמר בנותן מזרעו למולך ונתתי אני את פני באיש ההוא מפי השמועה למדו ההוא לא אנוס ולא שוגג ולא מוטעה. ומה אם עבודת כוכבים שהיא חמורה מן הכל העובד אותה באונס אינו חייב כרת ואין צריך לומר מיתת בית דין. קל וחומר לשאר מצות האמורות בתורה. ובעריות הוא אומר ולנערה לא תעשה דבר. אבל אם יכול למלט נפשו ולברוח מתחת יד המלך הרשע ואינו עושה הנה הוא ככלב שב על קיאו. והוא נקרא עובד עבודת כוכבים במזיד והוא נטרד מן העולם הבא ויורד למדרגה התחתונה של גיהנם:

If anyone about whom it is said: "Transgress and do not sacrifice your life," sacrifices his life and does not transgress, he is held accountable for his life.

When anyone about whom it is said: "Sacrifice your life and do not transgress," sacrifices his life and does not transgress, he sanctifies [God's] name. If he does so in the presence of ten Jews, he sanctifies [God's] name in public, like Daniel, Chananiah, Mishael, Azariah, and Rabbi Akiva and his colleagues. These are those slain by [the wicked] kingdom, above whom there is no higher level. Concerning them, [Psalms 44:23] states: "For Your sake, we have been slain all day, we are viewed as sheep for the slaughter," and [Psalms 50:5] states: "Gather unto Me, My pious ones, those who have made a covenant with Me by slaughter."

When anyone about whom it is said: "Sacrifice your life and do not transgress," transgresses instead of sacrificing his life, he desecrates [God's] name. If he does so in the presence of ten Jews, he desecrates [God's] name in public, nullifies [the fulfillment of] the positive commandment of the sanctification of [God's] name, and violates the negative commandment against the desecration of God's name.

Nevertheless, since he was forced to transgress, he is not [punished by] lashing, and, needless to say, is not executed by the court even if he was forced to slay [a person]. The [punishments of] lashes and execution are administered only to one who transgresses voluntarily, [when the transgression is observed by] witnesses, and [when] a warning [was given], as [Leviticus 20:5] states concerning one who gives his children to [the worship of] Molech: "I will turn My face against that person."

The oral tradition teaches [that we can infer]: "that person" and not one who is forced [to transgress, who transgresses] inadvertently, or [who transgresses] because of an error. If, concerning the worship of false gods, which is the most serious [of sins], a person who is forced to worship is not liable for karet, nor, needless to say, execution by a court, how much more so [does this principle apply] regarding the other mitzvot of the Torah? [Similarly,] regarding forbidden sexual relations, [Deuteronomy 22:26] states: "Do not do anything to the maiden."

One who could, however, escape and flee from under the power of a wicked king and fails to do so is like a dog who returns [to lick] his vomit. He is considered as one who worships false gods willingly. He will be prevented from reaching the world to come and will descend to the lowest levels of Gehinnom.

There is SOOOOOO much to say on this Rambam. I hope to get to some of it if Hashem gives me the time, money, health and good spirits. But in the meantime - one famous kashya:

In this halacha the Rambam says that if one did the aveirah באונס he is not punished. But two halachos later [5/6] the Rambam says that one IS punished for an aveirah done out of אונס if it was one of the big three.

כענין שאמרו באונסין כך אמרו בחלאים. כיצד מי שחלה ונטה למות ואמרו הרופאים שרפואתו בדבר פלוני מאיסורין שבתורה עושין. ומתרפאין בכל איסורין שבתורה במקום סכנה חוץ מעבודת כוכבים וגילוי עריות ושפיכת דמים שאפילו במקום סכנה אין מתרפאין בהן. ואם עבר ונתרפא עונשין אותו בית דין עונש הראוי לו:



Just as these principles apply regarding being forced [to transgress], they also apply regarding sicknesses. What is implied?

When a person becomes sick and is in danger of dying, if the physicians say that his cure involves transgressing a given Torah prohibition, [the physicians' advice] should be followed. When there is a danger [to life], one may use any of the Torah prohibitions as a remedy, with the exception of the worship of false gods, forbidden sexual relations, and murder. Even when there is a danger [to life], one may not use them as a remedy. If one transgresses and uses them as a remedy, the court may impose the appropriate punishment upon him.

Hmmmmmmmm!

The Passing Of A Jewish Jew Hater

"When the whole world doesn't believe in G-d, it'll be a great place."

This was said by Phillip Roth, the recently deceased Jewish novelist who is now, sadly, in gehenom and a BIG believer in G-d. As our President likes to say "HUUUUGEEE". He never explained why the world will be such a great place when people don't believe in G-d. So that there will no longer be any reason compelling a person not to kill, steal, rape, cheat, lie etc. etc. How wonderful!!!

"I find religious people hideous". Some of the worst Anti-Semites are Jewish. There are deep complex reasons for this. As Yeshayahu said מהרסיך ומחריביך ממך יצאו. I wonder how a seemingly intelligent man can group together millions of people and say they are all hideous when many of them are by all accounts very fine human beings, doctors, nurses, teachers, psychologists etc. etc. When religious Jews give a tremendous amount of tzdaka and likely do more acts of kindness per capita than any other group in the world. Is there an organization of atheists who visit patients in the hospital on a daily basis, providing them and their families with food and emotional comfort, free of charge?? What good did Mr. Roth do in his lifetime making him better than all of the "hideous" religious people?

"It's all a big lie". What is a big lie?? That the world didn't create itself from nothing?? Does he have any scientific proof for that? Did Mr. Roth even witness anything creating itself from nothing [not even out of thin air because before there was a world, there was no thin air. Nor was there energy which makes one wonder how the Big Bang happened [assuming it happened as most scientists do today] without energy. And if there was energy, Who put it there? The energy created itself? From WHAT??]

Ahhhhh - but atheism has a GREAT record. I quote the brilliant scientist and mathematician David Berlinski:

And as far as we can tell, very few of those carrying out the horrors of the twentieth century worried overmuch that G-d was watching what they were doing either. Maybe if you had meaning in your life you would not have been filled with fear, loneliness and anxiety? Religion, takeh [Spanish for "assimilated Jews are a sorry bunch"], would have saved you. If you would have been religious the odds of you having died after two divorces [from non-Jewish women] and zero children, would have been very slim.

Worrying About Klal Yisrael

Can So Many People Be SOOOOO Wrong? Did Hashem Ever Text Us? Breaking Up - We Could Be REALLY Bad At Times

Continuing the thought from the previous post....

There are over 2 BILLION Christians in the world. That is about 32 percent of the world's population. Not that I counted but I trust the information I accessed. Imagine if they would all give but one dollar per person a year to support yeshivos!! Boy - that would be the end of every yeshiva's financial woes.... Ahhhhh:-). 

Anyway, Christianity is the wayward child of Judaism. Its leader was Jewish and they maintain that the Tanach is a holy, Divinely written or at least Divinely inspired work. That means that they all believe [officially] that we, the Jews, were the chosen people. The Tanach is quite clear about that in many places. So what happened??

We were rejected. No more. Now to be saved one must believe in Yoshke and he or she [today it is no longer "he or she". One can be both, either or neither:-)] is set. [To be fair Christians are also encouraged - sometimes, like when priests weren't handing Jews over to the Nazis, or sexually abusing little boys - to live moral lives, which historically has not always been the case but this post is not about history but about theology. There is a tremendous amount of hypocrisy and evil intermingled with Jewish values such as tzdaka. So the average Christian might be a good person and might not - like everyone else on the planet].   

Since they believe in Tanach it is interesting to explore if the possibility of the Jews being rejected is ever considered. In fact, we see AGAIN AND AGAIN in the Chumash and in the later books of Neviim that it is prophesied that the Jews will veer from the path, they will sin, they will be unfaithful, they will sleep with Gentile women [end of parshas Pinchas], they will sleep with Jewish wives, but not only their own because they will swap wives [!!! See Amos 6-4 with Rashi based on the Gemara], they will be killers and thieves [see the first perek of Yeshayahu], they will serve idols [all over Tanach] etc. etc. We might control the worlds banks because we also have a not so geshmak side to us....

YET!!!!! Despite everything Hashem never says "Fellows, I am done with you. We're finished". The ol' text "Sorry Rachel but this relationship is OVER. I have met another women and she is much better than you. It was cool while it lasted. You're a cheat. Have a great life. Dave." NEVER. Time and again we find that we are promised that after we stray and are punished, we return to Hashem and are accepted with open arms. For example, in Hoshea, after we are compared to an unfaithful wife, we return and Hashem says וארשתיך לי לעולם וארשתיך לי בצדק ובמשפט ובחסד וברחמים - We are FOREVER betrothed to Hashem.

There is no HINT ANYWHERE that at any time the need to keep the Torah is revoked and that belief [that a human being is god] is enough [as they claim]. Ever. On the contrary, we are warned NEVER to add or subtract from the Torah [Devarim 13/1].  

אֵת כָּל הַדָּבָר אֲשֶׁר אָנֹכִי מְצַוֶּה אֶתְכֶם אֹתוֹ תִשְׁמְרוּ לַעֲשׂוֹת לֹא תֹסֵף עָלָיו וְלֹא תִגְרַע מִמֶּנּוּ.

Not only that, we are told that if someone comes and says in the name of G-d that we should serve idols [such as turning a human being into G-d], he should be ignored and killed [Devarim 13/2 and on and Devarim 18].

It is clear that the Jews are chosen forever - regardless of how we behave at any given point. 

There is a prophecy [Zechariah 8/23] that at THE END OF DAYS, ten gentiles will grab the garment of the Jew  and ask to follow him because Hashem is with him.

כֹּה אָמַר יְ-ה-וָה צְבָאוֹת בַּיָּמִים הָהֵמָּה אֲשֶׁר יַחֲזִיקוּ עֲשָׂרָה אֲנָשִׁים מִכֹּל לְשֹׁנוֹת הַגּוֹיִם וְהֶחֱזִיקוּ בִּכְנַף אִישׁ יְהוּדִי לֵאמֹר נֵלְכָה עִמָּכֶם כִּי שָׁמַעְנוּ אֱלֹהִים עִמָּכֶם.

Aren't we supposed to be rejected by then? No - never. Until and including the end of days we are Hashem's chosen people.

So the foundation of the entire Christian belief system runs entirely contrary to their belief system.

Kedushas Eretz Yisrael - Prophetic Symbols

Here is a letter from Rav Hutner to Rav Zvi Yehuda Kook from 1929 [Rav Hutner was 23 at the time]. Rav Zvi Yehuda's wife was Rav Hunter's cousin [which explains the fact that the letter is addressed to her as well and she is affectionately called " אשת חבר כחבר חוה לאה היקרה". It is rare that rabbinic correspondence is also addressed to the wife.]

First he talks about Kedushas Eretz Yisrael and that he only appreciated its kedusha after leaving and experiencing the relative darkness of חוץ לארץ. When he returns he will know how to breathe her holy air on a completely different level.

He met a chashuv Rav who criticized the philosophy of Rav Kook and Rav Hutner said "First move to Eretz Yisrael and then we'll talk [!!]".

He then  talks about the need of the Navi to use symbols in order to express the words and "feelings" of Hashem. Sometimes rebuke is not enough and concrete deeds are required [such as Yeshayahu going naked and barefoot to show how the king of Ashur will led the exiles - פרק כ]. This is starkly expressed in the prophecy of Hoshea [פרק א] where he is told to marry a Zonah to symbolize the behavior of the Jews who have cheated on their "Husband" [Hashem]. Ultimately there is a reconciliation between the wayward wife and her Husband. We see that the chosenness of the Jews requires symbols in order to bring the concept into our concrete world and out of the abstract.  

Li-myseh - Learn Kisvei HaRav ztz"l and TASTE Eretz Yisrael, wherever you may be! But being here is a completely different experience.

ואני בעצמי כמעט תמיד רוחשים ולוחשים בי הרהורי געגועים וכסופים קלים על ארץ ישראל, אולם לעתים תכופות יש אשר יתלכדו כולם לשטף אחד ועברוני ושטפוני על כל קרבי ועל כל הויתי. ולאמתו של דבר רק אחרי צאתי את הארץ נתחוור לי המושג ארץ ישראל לכל מלא היקיפו, וידועים דברי הזהר על הפסוק כיתרון האור מן החשך - דמן חשוכא ממש אתי תועלתא לנהורא דאלמלא חשוכא לא אשתמודע נהורא ומחשכת ארץ העמים שיש לגזור על אוירה משום גושה אתיא לי תועלתא להכרת אורות ארץ חמדה, וכמדומה לי עכשיו שאם אזכה לעלות ולהאחז בה שוב אדע כבר לנשום באוירה המחכים לגמרי בדרגא אחרת.

ומעין הרגשת סבי דבי אתונא בהריחם בנכר את ריח עפר ארצם ותחי רוחם, הנני מוצא עכשיו בעיוני בספריו של הרב שליט"א יש לי הרושם כאלו נתקפל בהם כעמודיהם בטוריהם הרבה הרבה מאוירא דארעא דישראל ובכל פעם מדי עייני בהם עולה באפי ריחה של ארץ חמדה וכל כגון דא כולי עלמא מודו דריחא מילתא היא. ברי לי עכשיו שעל ידי מי שלא טעם מטעמה של ישיבת ארץ ישראל לא ניתנו ספרים אלו להיכתב. אותה התפיסה האורגנית את אחדותה הכללית של כנסת ישראל לכל דורותיה ולכל שדרותיה ובכל הופעות הרוח השונות והמשונות שבאו על ידה לידי גילוי מקצה אחד ועד קצהו וכל אותם סגנוני הציורים ודרכי ההסברה שבהם, היא באה לכלל ביטוי בספרים הנ"ל אי אפשר להם שיולדו, כי אם על הרי יהודה וירושלים. ומכיון שעמדתי על המומנט המכריע של ארץ ישראל החי בכל עורקי מחשבותיהם והשקפותיהם נכנסו אצלי בהחלט לכלל "תורת ארץ ישראל".

ובאמת בימים אלה נפגשתי פה עם אדם חשוב אחד, יודע דבר ומבין מדע בהלכות דעות אשר בתורה, ודברתי אתו קצת ברוחן של ההשקפות הנ"ל וכשהלז הביע לי את התנגדותו ואת השגותיו עליהן, עניתי לו קצר ומפרש "עלה לארץ ישראל ואחר נדבר".

וכדי שלא יהיה בואי הפעם ביאה ריקנית, ארשום בכאן איזה מחשבה בענין אחד אשר עמום הוא עוד בידי ולדבריו אחכה. מוצאים אנחנו סמלים בנבואה כאשר הלך עבדי ישעיהו "ערום ויחף אות ומופת" וביחזקאל "שכב על צדך הימנית וגו" והענין ידוע קשורה היא ההפשטה בהגשמה ואף הנס זקוק לאיזה אחיזה בטבע ומעשי הגדול ממשיכים ומאמתים את ההשפעה העליונה וזה הוא מושג הסמל ברוח הקודש.

ועמדתי על ענין מיוחד שאנו מוצאים בזה בהפרק הראשון בהושע שנאמר לו "לך קח לך אשת זנונים וילדי זנונים וילך ויקח את גומר בת דבלים" ונישואי נבואה אלה לא באו לשם סמל של איזה משא העומד להתקיים בעתיד אלא בתור תשובה על מענתו של הושע העבירם באומה אחרת כדאמרינן בפסחים פ"ז. והרי הדברים נוקבים בחזיון האלקי הזה הלופת את עמודי ההויה ומקיף את יסוד בחירת עם ישראל. אי אפשר היה לו להושע למצות את כל עומק התהום שבנושא על ידי שום השגה של נבואה ורוח הקדש כי אם בצירוף הסברה מוחשית וטבעית כמו אשת זנונים וילדי זנונים זה הוא כמדומני המרחב הכי גדול שאפשר לנו לצייר בעילוי ההשגות הבאות לכלל חוש על השגות הרוח וההפשטה. ועדיין טעון בירור ובקשתי שטוחה לפניו שיודיע לי דעתו בנידון זה.

The Principle Upon Which Everything Is Based - A New French Term

The Rambam [Krias Shema 1/2] tells us about the 3 paragraphs of Shema:

ומה הוא קורא שלשה פרשיות אלו הן:

שמע והיה אם שמוע ויאמר ומקדימין לקרות פרשת שמע מפני שיש בה יחוד השם ואהבתו ותלמודו שהוא העיקר הגדול שהכל תלוי בו ואחריה והיה אם שמוע שיש בה צווי על (זכירת) שאר כל המצות ואחר כך פרשת ציצית שגם היא יש בה צווי זכירת כל המצות:

And what is it that one recites? These three sections:
"Shema Yisrael..." (Deuteronomy 6:4-9),
"And if you will listen..." (Deuteronomy 11:13-21),and
"And God said..." (Numbers 15:37-41).
We begin with the section of "Shema Yisrael" since it contains [the concept of] the unity of God, [the commandment of] loving Him and the study of Torah, it being a fundamental principle upon which everything is based.
After it, [we read] "And if you will listen...," since it contains the imperative to fulfill the rest of the commandments, and finally the portion of tzitzit, since it also contains the imperative of remembering all the commandments.

So the first paragraph of Shema contains the unity of Hashem, the command to love him and the study of Torah which is THE FUNDAMENTAL PRINCIPLE UPON WHICH EVERYTHING IS BASED.  This places the mitzvah of learning Torah on a completely different plateau. Not just a mitzvah like all mitzvos, not just כנגד כולם, but the principal upon which everything is based!!:-) Wow! But wait.... 

It is interesting to compare the Rambam in Hilchos Mezuza [6/13]:

חייב אדם להזהר במזוזה מפני שהיא חובת הכל תמיד וכל זמן שיכנס ויצא יפגע ביחוד השם שמו של הקדוש ב"ה ויזכור אהבתו ויעור משנתו ושגיותיו בהבלי הזמן וידע שאין דבר העומד לעולם ולעולמי עולמים אלא ידיעת צור העולם ומיד הוא חוזר לדעתו והולך בדרכי מישרים. 

A person must show great care in [the observance of the mitzvah of] mezuzah, because it is an obligation which is constantly incumbent upon everyone.

[Through its observance,] whenever a person enters or leaves [the house], he will encounter the unity of the name of the Holy One, blessed be He, and remember his love for Him. Thus, he will awake from his sleep and his obsession with the vanities of time, and recognize that there is nothing which lasts for eternity except the knowledge of the Creator of the world. This will motivate him to regain full awareness and follow the paths of the upright.

The three benefits of mezuzah correspond to what the Rambam mentioned about the first paragraph of Shema [where we actually conclude with a pasuk about mezuzah]. First - יחוד השם, the unity of Hashem. G-d is One! Then - Number 2 - LOVE. Number 3: .... and recognize that there is nothing which lasts for eternity except the knowledge of the Creator of the world. So in Hilchos Krias Shema that would parallel what the Rambam says " ותלמודו" - which must then mean not Talmudo in the sense of fulfilling the mitzvah of Talmud Torah but Talmudo which brings one to knowledge of G-d. Indeed, in Sefer Hamitzvos [מצוה ג] the Rambam writes that "והיו הדברים האלה אשר אנכי מצוך היום על לבבך" - learning Torah, brings one to a knowledge of Hashem. 


Kumpt ois [French for "The Rambam rocks!!"] - The "principal upon which everything is based" is learning Torah in order to achieve knowledge of Hashem and that "there is nothing which lasts for eternity except the knowledge of the Creator of the world".
