Pesach For The Sake Of Chullin - Part 1

לזכות שמחה בן נעכא גיטל לברכה והצלחה 
לזכות משה יהודה בן פעשא דינה 
לזכות ר' יהודה יעקב בן דינה חאשע

הפסח ששחטו במחשבת שינוי השם בין ששינה שמו לשם זבח אחר בין ששינהו לשם חולין פסול שנאמר ואמרתם זבח פסח הוא לה'. במה דברים אמורים? ששחטו בזמנו שהוא יום ארבעה עשר בניסן אפילו שחטו בשחרית במחשבת שינוי השם פסול אבל אם שחטו שלא בזמנו במחשבה שלא לשמו כשר שלא לשם בעליו נעשה כמי שאין לו בעלים בזמנו ופסול:



A Korban Pesach that was slaughtered for a different intent - whether for the sake of another sacrifice or whether as an ordinary animal - it is unacceptable, as it is written: "And you shall say, 'It is a Korban unto God,'

When does the above apply? When it was slaughtered on its appropriate time, the day of the fourteenth of Nisan. Moreover, even if it was slaughtered in the morning of that day for a different intent, it is unacceptable. If, however, one slaughtered it with a different intent at a time not appropriate for its [sacrifice], it is acceptable.

[If it was slaughtered] for the sake of others and not for its owner, it is considered as if it did not have an owner on the day [when it should be sacrificed] and it is unacceptable. [Psulei Mukdashim 15/11]

This Rambam caused more of an uproar than all of  [להבדיל] President Trump's tweets put together! 

When it comes to Korban Chatas [which like the Korban Pesach also requires כוונה לשמה and if he had כונה for a different korban he is not yotzei], the Rambam paskened that כוונה for the sake of חולין is not מעכב? This is based on Rav [Zevachim 3a-b] who said that Kodshim shechted for the sake of Chullin are kosher. He has two possible sources:

דמינה מחריב בה דלאו מינה לא מחריב בה

Only מינה - the same category [of Kodshim] destroys but not a different category [chullin]. 

Or from a גזירת הכתוב:

"ולא יחללו את קדשי בני ישראל את אשר ירימו לה'" - קדשים מחללין קדשים ואין חולין מחללין קדשים.

According to either source - why should we make a distinction between חטאת and פסח??

The answer would be found if we can identify how Pesach is different, distinct and unique from other korbanos [including Chatas]. 

I asked the great Gaon Rav Chanoch Henech Eigis and he answered that unlike all other korbanos, one must have special כוונה for the sake of Pesach - סתמן לאו כלשמן, and when he has כוונה for the sake of Chullin it shters and disqualifies the Korban Pesach. So it is not the fact the he had כוונה for חולין that is the problem but the fact that he didn't have כוונה לשם פסח.
