Lashon Hara About Baalei Machlokes

הלכות לשון הרע, כלל ח', סעיף ח'

ההיתר שיש לספר לשון הרע על בעלי מחלוקת, הוא דווקא אם הוא רואה שעל ידי שיספר לאנשים את גודל התרמית במחלוקת, יראו האנשים שהבעלי מחלוקת לא צודקים, ולא יצטרפו למחלוקת, ומתוך זה תתבטל המריבה. אבל צריך שימלאו הפרטים הבאים:
א. שהדברים שעליהם התבסס שהם בעלי מחלוקת, שיידע בעצמו ולא יסמוך על שמיעה מאחרים.
ב. צריך שיכווין לתועלת, ולא מצד שנאה.
ג. אם באפשרותו להשקיט את המריבה באופן אחר בלי לדבר לשון הרע, כגון על ידי הוכחה, אסור לו לספר לשון הרע עליהם. אלא כן הוא ירא להוכיחם, כיון שאז יראו בעלי המחלוקת שהוא לא איתם, ויפרו את עצתו להשבית את המריבה. אבל צריך שיקול דעת גדול, ולא יחליט מהר איזה צד צודק במחלוקת, ויתבונן היטב על פי התורה מי צודק. ואם הוא בספק – שב ואל תעשה עדיף ולא יספר לשון הרע אף להשבית את המחלוקת.

אסור לחרף ולגדף את המתים. וכתבו הפוסקים שיש תקנה וחרם קדמונים, לא להוציא לעז ושם רע על המתים. וכל זה אפילו אם המת עם הארץ. וכל שכן אם הוא תלמיד חכם, בוודאי המבזה אותו עוון חמור הוא. וחייב נדוי על זה. ואיסור ביזוי תלמיד חכם הוא אפילו אם מבזה את התלמיד חכם עצמו, וכל שכן שאסור לבזות את דברי תורתו.


Hilchos Lashon Hara chapter 8, section 8. 

There is an opinion that one may speak lashon hara about baalei machlokes - people wrongfully quarreling with others. This only applies if one sees that by showing people their great dishonesty in this matter they will understand they are wrong and this will quiet the controversy. Without this, this case is no different. Also, the following conditions must be met:
a) One must know the facts indicating they are baalei machlokes personally and not rely on hearsay from others unless it is clear to one that it is true.
b) One must have the above benefit in mind and not speak because of hatred.
c) If one can quiet the controversy in some other way without speaking of them, such as by administering rebuke, one may not speak lashon hara about them. Sometimes one is afraid to rebuke such people lest, realizing that he is not on their side the baalei machlokes may circumvent his plan [to stop the quarrel] and leave him with no way to emend the situation. However, matters like these require great deliberation. A person should not be quick to decide which side of the quarrel involves baalei machlokes, but consider the situation according to Torah law. If he cannot decide, it is better to do nothing.

Hilchos Lashon Hara chapter 8, section 9

Know also that it is forbidden to disparage and insult the dead. The poskim write that the early sages made an enactment and a ban not to speak evil of the dead. This applies even if the deceased is unlearned. If he is a Torah scholar disparaging him is an enormous sin that deserves excommunication as the Yoreh Deah rules (243:7). The prohibition against disparaging a Torah scholar applies even to disparaging him, and how much more so to disparaging his Torah.
