The Difference Between ממון and קנס - Part 2

The Gemara in Bava Metzia [34] brings a list of cases where the animal was stolen but the נפקד declined to swear to avoid having to pay but didn't yet pay. Then the גנב was caught and had to pay כפל. Who gets the money? [Had the נפקד actually paid - the כפל would be his]. The Rif says that in all of these cases the מפקיד and נפקד split the money.  

Asked the Kuntres Hasfeikos: Why don't we say המוציא מחברו עליו הראיה and the גנב can tell each one "prove to me that I owe you" which they can't do. So why should he have to pay at all?? He proves this from the Gemara [Bechoros 48b] that says that if 2 fathers paid the kohen in advance for the pidyon haben and one of the babies died beforehand but we don't know which - the kohen doesn't have to return the money b/c he can tell each father "prove to me that it was your son" which they can't do.

 ב"מ (לד, א): "פשיטא אמר איני משלם וחזר ואמר הריני משלם, הא קאמר הריני משלם, אלא אמר הריני משלם וחזר ואמר איני משלם מאי וכו'. שאל מן האשה ושילם לבעלה מאי, אשה ששאלה ושילם בעלה מאי, תיקו".
