ב-28 למאי 1944 הגיע בראנד לקושטא ודווח למשלחת הסוכנות היהודית על פרטי ההשמדה ועל ההצעה להפציץ את אושוויץ וקווי הרכבת המובילות אליה. במשפט קסטנר נדונה לא פעם השאלה למה לא פנו ראשי הסוכנות בתביעה זו אל מדינות הברית. שום מענה לא נמצא בפיהם, בן גוריון ושרת התחמקו אף מלהופיע לפני בית המשפט ולהסביר את העדר הפעולה החיונית. רק כעבור ארבע שנים, במשפט אייכמן, הקדימה הסוכנות רפואה למכה והגישה לבית המשפט מבלי שתתבע בכלל מסמכים המעידים על פניות שנעשו כביכול אל ממשלת בריטניה בענין הפצצת אושוויץ.
ראה זה פלא, שנים כה רבות לא ידעו דבר על המסמכים האלה ולפתע נתגלו בגנזך של הסוכנות. אולם גם הפעם התחמקו בן גוריון ושרת למסור לפני בית המשפט הסברים בעל פה והתובע הכללי כרכר והתפתל באמנות מפליאה ובלבד שלא יזדקק לכך. "ניו יורק טיימס" מ-1 ביוני 1961 שואל: "כיצד זה יתכן, כי במשך שנה שלימה אסף התובע הכללי של מדינת ישראל עדויות מכל קצווי תבל ופה לנגד עיניו, מצוי עד חשוב ביותר משה שרת והוא מוותר על עדותו?".
אולם גם אם מאן דהו יהגה בתמימותו הרבה אמון במסמכים שנתגלו בגניזה (המרשל של האוירה הבריטית בתקופת המלחמה סיר ארטור הריס וכן ראש הממשלה דאז צ'רצ'יל, מכחישים כאילו הגיעה אליהם פניה מעין זו מהסוכנות), גם אז תשאר קושיא חמורה במקומה: מכתבו של ויצמן אל ממשלת ברטניה נושא את התאריך של 6 ביולי, ז.א. עשרים ושלשה ימים לאחר קבלת הדו"ח וההצעה מברנד. במשך עשרים ושלשה ימים אלו של התרשלות נשרפו 276 אלף יהודים באושוויץ – תריסר אלף ליום. הישוב שוקט אז על שמריו, אינו יוצא בהפגנות להרעיש שמים וארץ, אינו מפגיז את דעת הקהל בעולם כולו בתביעה מאוחדת: השמידו את אושוויץ, הצילו את המועמדים לשריפה. במה עוסק הישוב וראשיו? בחירות "לכנסת ישראל". 201 אסיפות בחירות מקיימת מפא"י בלבד ושעתו של "בן גוריון – ושרת" פנויה ופנויה להשתתף בהן במלא המרץ. ב-30 ליולי שוב בחירות... לועידת הפקידים. בן גוריון מכריז: "מי שלא ישתתף בבחירות דומה לחייל הבורח מן המערכה. כולם נקראים להשתתף במערכותנו". זוהי מערכתו של "בן גוריון", בעת להטו הכבשנים.
On May 28, 1944, Brand arrived in Istanbul and reported to the Jewish Agency delegation on the details of the extermination and the proposal to bomb Auschwitz and the railway lines leading to it. During the Kastner trial, the question arose more than once: why did the leaders of the Agency not approach the Allied powers with this demand? No answer was offered by them; Ben-Gurion and Sharett even evaded testifying before the court to explain this lack of vital action. Only four years later, during the Eichmann trial, did the Agency take preemptive steps and submit to the court—without being asked at all—documents purportedly testifying to appeals made to the British government regarding the bombing of Auschwitz.
Lo and behold, for so many years nothing was known about these documents, and suddenly they turned up in the Agency's archives. However, even then, Ben-Gurion and Sharett avoided offering oral explanations before the court, and the Attorney General danced and maneuvered with wondrous artistry just to avoid resorting to it. The New York Times of June 1, 1961, asked: "How can it be that for a full year the Attorney General of the State of Israel gathered testimonies from across the globe, yet right before his eyes stood a witness of the utmost importance—Moshe Sharett—and he waived his testimony?"
Yet even if someone, in utter naivety, placed great faith in the documents uncovered in the archives (the wartime Marshal of the Royal Air Force, Sir Arthur Harris, as well as then-Prime Minister Churchill, denied that any such appeal from the Agency ever reached them), a grave difficulty remains: Weizmann's letter to the British government bears the date of July 6—that is, twenty-three days after receiving the report and proposal from Brand. During these twenty-three days of negligence, 276,000 Jews were burned in Auschwitz—twelve thousand a day.
The Yishuv remained complacent at the time; it did not take to the streets in demonstrations to shake heaven and earth, nor did it bombard world public opinion with a unified demand: destroy Auschwitz, save those marked for the flames. What occupied the Yishuv and its leaders? Elections to the "Knesset Yisrael." Mapai alone held 201 election rallies, and "Ben-Gurion and Sharett" had ample time to participate in them with full vigor. On July 30, elections again... for the Clerks' Union convention. Ben-Gurion proclaimed: "Whoever does not participate in the elections is like a soldier fleeing the battlefield. Everyone is called upon to participate in our campaigns." This was "Ben-Gurion's campaign," while the crematoria were ablaze.
