We all know the gemara [Bava Metzia 59] that a Bas Kol came out and paskened the halacha. The rabbis said "sorry - לא בשמים היא".
Great.
- But what were they thinking in שמים? Don't they pasken in שמים that לא בשמים היא??
- If לא בשמים היא then how can תיקו be an acronym for תשבי יתרץ קושיות ובעיות? Eliyahu is a prophet, is he not? So how can he decide halacha?
- The gemara in Gittin [6] says that Rav Evyatar would spend time with Eliyahu Hanavi. That being the case - why didn't he ask him to resolve all of the תיקו's in the gemara???
