Does A Woman Have To Be On "Stand-by" For A Divorce In Order For The Get To Be Kosher? - Questions Asked In Prehistoric Times

In the mishna we quoted in the previous post we saw that a get must be written for the sake of the woman being divorced. [The man says to his soon to be "ex" in a romantic tone of voice "Darling, I wrote this ESPECIALLY for you..."]. The gemara at the beginning of Zevachim says that a get written with no specific intention for a particular woman - סתמא - is pasul, because a married woman is never on "stand-by" to get divorced. Tosfos in Zevachim explain that even if she was מזנה [and she is now אסור to her husband] that doesn't mean that he will necessarily divorce her with THIS get [written סתמא] or that he will divorce her at all. Maybe he will just separate from her and be done with it!!

ובעיקר דברי התוס' ריש זבחים [ב ע"ב] דכשאשה לאו לגירושין קיימא לא חשוב לשמה, יש מקום עיון מהא דגיטין (י"ח ע"א) דכתבו ואנחי' בכיסתי' דאי מפייסה תפייס, והא אינו ברור דלגירושין קיימא, וביותר בקידושין [ט ע"ב] כתבו לשמה ושלא מדעתה דרבא ורבינא אמרי מקודשת, והא לאו לקידושין קיימא, כיון שעדיין לא נמלך בה, ומנ"ל שתתרצית, ועוד מעשים בכל יום ששולחין גט לאשה ועדיין לא נתרצית לקבל הגט והיא משמרת עצמה בכל יום שלא ישיגוה בעלי חצים השליח והעדים, ובשעת כתיבה עוד לאו לגירושין קיימא, ויש עוד מקום עיון מהא דריש יומא [ב ע"א] ומתקינין כהן אחר תחתיו, ופשוט שצריך להכין בעדו בגדי כה"ג שיהיו כמדתו, וכ"כ בתוס' ישנים שם, ולפמ"ש הרמב"ן פ' תצוה [שמות כ"ח פס' ב'] שבגדי כהונה הי' צריך עשי' לשמה, וכן הוא בירושלמי פרק ג' דיומא [יז ע"א] והרי בגדים אלו לאו לעבודה קיימא דאטו הדבר עומד שיפסול כה"ג ראשון, מיהו בזה יש לחלק דשאני גט שאין בו קדושה והלשמה הוא רק שיגרש בו, אבל בגדי כהונה הלשמה שיהי' עליהם קדושת בגדי כהונה, יעבוד בהם או לא יעבוד, קדושתם עליהם, אך קושיות ראשונות צ"ע כעת.


He gives numerous examples of where the women is divorced or married with a shtar even though she was not on "stand-by" to get divorced or married. So we see - NOT like Tosfos [or even the gemara?] - that a woman can get divorced even though when the get was written we didn't know if she was actually going to get divorced.


I saw in a journal called פנים מאירות from Elul 1981 [loooong before Al Gore invented the Internet, Mark Zuckerberg was not yet born and approximately when people started bringing the now ancient PC's into their homes - in short, pre-historic times. I was going into 6th grade. There were people alive who remembered living in the 1800's] that HaGaon HaGadol  Rav Nosson Geshtetner ztz"l [who wrote over 6o sefarim and has another HUNDRED (!!!) or so in manuscript form - this journal was published by his yeshiva] could not make sense of the Avnei Nezer. The gemara in Zevachim and Tosfos' issue is that a get written סתמא cannot be given to a woman not on "stand-by" to get married. In all of the examples the Avnei Nezer brought, the get was written FOR THIS WOMAN specifically. In such a case, the get is valid and it doesn't bother us that we don't know whether the get will actually be used to divorce her.
