The Issur That Starts With The Ma'ase Aveirah And An Issur That Already Exists Before The Ma'ase Aveirah

The Rambam [Maachalos Asuros 14/7] writes:

האוכל אכילה גדולה מדבר אסור אין מחייבין אותו מלקות או כרת על כל כזית וכזית אלא חיוב אחד לכל האכילה. ואם היו העדים מתרים בו בשעת אכילה על כל כזית וכזית חייב על כל התראה והתראה ואף על פי שהיא אכילה אחת ולא הפסיק:

When a person partakes of a large amount of food from a forbidden substance, he is not liable for lashes or kareis for every olive-sized portion he eats. Instead, he is liable once for all he ate. If, however, the witness gave him a warning for every olive-sized portion, he is liable for every warning even though he ate it in one sitting, without interruption. 

We learn that without a separate warning, he is only liable one time for a large amount of food. 

How does this halacha square with another Rambam [ibid 8/3]:



אבל כזית מגיד של ימין וכזית מגיד של שמאל או שאכל שני גידים כולן אף על פי שאין בהן כזית לוקה שמונים (וכן הוא לוקה על כל גיד וגיד): 



When a person eats an olive-sized portion of the gid on the right side and an olive-sized portion of the gid on the left side, or he ate two entire giddim even if they are not the size of an olive, he receives 80 lashes. He is given lashes for every gid independently.

Here we see that he is liable for every kezais even without separate warnings. 

How do we understand this conundrum? How is Gid Hanashe different from other איסורי אכילה?

The Rogochover explains based on the gemara [Chullin 92b] that Gid Hanashe is really not "food" but just like wood - עץ הוא והתורה חייבה עליו. Therefore

 "כיון דבאמת קי"ל דאין בגידין בנותן טעם רק עץ הוא, והתורה חייבה עליו, יש עליו שם דבר בפני עצמו. ר"ל כך: דכל האיסורים יש עליהם שם האיסור קודם האכילה ולכך צריך לחלק בהתראות משא"כ גבי גיד דהאיסור הוא האכילה וכל זמן שלא אכלו אין עליו שם איסור כלל ..... ולכך אין צריך התראה לחלק". [צפנת פענח מאכלות אסורות ב-כ"ה]. 

Meaning - regular forbidden food is already forbidden so we require distinct warnings to separate the prohibited acts. Gid Hanashe is not even food before it is eaten. The איסור אכילה is created with each act of eating. So every מעשה אכילה generates 
a new לאו even in the absence of a separate התראה. Regarding regular forbidden food where the food is already forbidden before being consumed, we cannot say that every מעשה אכילה creates a new איסור. Therefore we need a separate התראה. In contrast to this, it is only when one actually consumes the גיד הנשה that the איסור is created. Hence, with every מעשה אכילה [of a kezais or complete גיד] he is liable once again. We don't need to revert to separate התראות.

With this understanding the Rebbe ztz"l sheds light on a gemara in Chullin [90b]. There is a machlokes whether the Gid Hanashe goes on the mizbeach with the korban. Rav Chisda says yes and Rav Huna says no because it is forbidden to be eaten and the rule is ממשקה ישראל - מן המותר לישראל, anything that goes on the mizbeach must be permitted to be eaten by a person. 

That is a strong argument! How is Rav Chisda going to deal with that? How can he say that we put something forbidden for consumption on the mizbeach? I often tell people that for problems go to therapy but this problem requires a different type of solution...

The answer is [הלכות תרומות עמ' 59] that Gid Hanashe is NOT forbidden to be eaten until it is actually eaten. The מעשה אכילה creates the איסור. How sweet then is the opinion of Rav Chisda! When the Gid Hanashe goes on the mizbeach it is not אסור באכילה. Unlike other איסורי אכילה, here the איסור only begins when the food is actually eaten. So when it goes on the mizbeach it is still not אסור באכילה.
