Maybe He Was מזיד

Reb Shmuel Rozovsky ztz"l asks a disarmingly simple question on Tosfos that really gets you thinking: Why do they say that the accused can claim מזיד הייתי and thus we shouldn't accept the testimony of the witnesses. Even IN THE ABSENCE the claim of the accused, we ourselves should suspect that maybe he was מזיד?!!
