I just heard a delicious piece of amaratzus. Rabbi Hesayslotsof Sillythings claimed that he has a proof that in Israel we are involved in a מלחמת מצוה. The proof is "הבא להרגך השכם להרגו" - when someone comes to kill you then you should beat him to it and kill him.
AHA!!!
The concept of מלחמת מצוה is a Halachic concept and category with specific rules and parameters that have nothing to do with הבא להרגך which relates to an individual engaging in self-defense. According to the simple reading of the Rambam in Hilchos Melachim [5-1] in order to wage war we need a King. In order to appoint a King we need a Sanhedrin and a Navi [1-4]. [Putting aside the famous chiddush quoted thousands of times in the name of the Rav ztz"l in Mishpat Kohen. זיע"א]. Today there is no Sanhedrin, no Navi and hence no King. Of course those who do engage in war against our enemies are doing a mitzva of לא תעמוד על דם רעך and חסד. But that doesn't categorize the war as a "מלמחת מצוה".
