Soldiers And Doctors Returning Home On Shabbos

There is a famous question in Halacha about doctors or hatzala people returning home after treating patients on Shabbos. The source is a sugya in Eiruvin. Hopefully we will get more into Halacha in a future post but for now I would just like to learn the gemara, see what the Rambam says, ask a question and touch upon halachic ramifications.

So first the gemara in the original language [with the commentary of the sefer "Chavrusa" incorporated into the text] followed by the English translation.  


מי שיצא [חוץ לתחום] ברשות, [כגון שהלך להעיד עדות החודש וכפי שנתבאר במשנה בראש השנה דף כ:, שמחללין את השבת לבוא להעיד עדות החודש של חדשי ניסן ותשרי, או שיצא להציל נפשות, או מילדת שיצאה חוץ לתחום עירה כדי לילד.]
ואמרו לו [בעודו בדרך]: כבר נעשה המעשה [שלשמו יצא חוץ לתחום וכבר אין צורך בו, וכל שכן אם הגיע לאותו מקום והיה בו צורך. הרי: אף על גב שאפילו מי שיצא באונס חוץ לתחום אין לו אלא ארבע אמות, זה שיצא ברשות עדיף, ו]יש לו אלפים אמה לכל רוח [מהמקום אשר הוא שם בעת שהודיעוהו או בעת שהציל]. אם היה [בשעה שהודיעוהו] בתוך התחום כאילו לא יצא.
כל היוצאים להציל חוזרין למקומן. 

שנינו במשנה: וכל היוצאין להציל חוזרין למקומן:
ומשמע דהכי קאמר, שאם יצא חוץ לתחום כדי להציל נפשות דהיינו יצא ברשות יכול לחזור לעירו ולתחומו מכל מקום שנמצא, ולהכי מקשינן:
וכי אפילו אם יצא חוץ לעיר טובא [הרבה] - יותר מאלפיים אמה מסוף תחום העיר - מותרין הן לחזור למקומן?!
והא אמרת ברישא דמתניתין: מי שיצא ברשות וכו' יש לו אלפים אמה ממקום שהודיעוהו - והוא הדין ממקום שהציל - ותו לא, והאיך נאמר שיש לו יותר מאלפיים אמה?!
אמר רב יהודה, אמר רב: אין המשנה באה לומר דין מדיני תחומין, אלא הכי קאמר:
שכל היוצאין להציל שכלי זיינן עליהן, חוזרין בכלי זיין שלהן למקומן [כלומר: עד המקום שהתירו להם חכמים], ואין אומרים כיון שנעשה מעשה ישליכו כלי זיינו מעליהן ולא יחללו שבת בהעברת ארבע אמות ברשות הרבים ובהכנסה מרשות הרבים לרשות היחיד [רבינו יהונתן], והטעם מפרש בגמרא לקמן.
ותמהינן אקושיא שהקשינו - לפי פשטות המשנה דמשמע שמותר להם לחזור לעירם ואפילו רחוקה היא יותר מאלפיים אמה - מרישא דמתניתין דביוצא ברשות אין לו אלא אלפים אמה:
ומאי קושיא היא?!
דילמא רישא דמתניתין מיירי רק בעדות החודש או במילדת, וסיפא דמתניתין במי שיצא להציל מן האויבים, ולהציל מן האויבים שאני, שיש לחוש שמא ירדפו האויבים אחריו ולכך מותר לו להכנס לעיר אף שהיא רחוקה הרבה?!
אלא אי קשיא הא קשיא, כלומר: מכח קושיא אחרת הוא שפירש רב שמשנתנו באה לומר שחוזרין בכלי זיינן למקומן, שהוקשה לו ממשנה אחרת שמוכח מינה שאף היוצא להציל מן האויבים אין לו אלא אלפיים אמה.
דתנן במסכת ראש השנה גבי עדי קידוש החודש שיצאו חוץ לתחומם כדי להעיד:
בראשונה לא היו זזין העדים שבאו להעיד משם [מבית הדין שבאו להעיד בפניו] כל היום כולו כשאר יוצאין חוץ לתחום שאין להם אלא ארבע אמות; התקין רבן גמליאל הזקן: שיש להן אלפים אמה לכל רוח.
ולא אלו בלבד אמרו שיש להן אלפיים אמה לכל רוח, אלא אפילו חכמה [מילדת] הבאה לילד והבא להציל מן הגייס [חיל אויבים] ומן הנהר [שעלה על גדותיו ושוטף את בני העיר ואת הילדים, רש"י שם] ומן המפולת ומן הדליקה הרי הן כאנשי העיר שבאו לשם, ויש להן אלפים אמה לכל רוח.
והיינו דקשיא לן:
וכי תו [יותר מאלפים אמה לכל רוח] לא מותר לצאת למי שבא להציל מן הגייס?!
והא אמרת במשנתנו: כל היוצאין "להציל" חוזרין עד למקומן, ומשמע אפילו טובא מאלפיים אמה?!
ומכח קושיא זו הוא שאמר רב [יהודה אמר רב] לפרש משנתנו: שחוזרין בכלי זיין למקומן.
וכדתניא שמותרין לחזור בכלי זיין למקומן:
דתניא: בראשונה היו מניחין כלי זיינן בחזירתן בבית הסמוך לחומה; פעם אחת הכירו בהן אויבים שיצאו חוץ לעיר, ורדפו אחריהם, ונכנסו המצילין ליטול כלי זיינן מאותו בית שם הניחום, ונכנסו האויבים אחריהם, ומתוך שהיה הבית צר דחקו המצילים זה את זה והרגו זה את זה יותר ממה שהרגו בהם האויבים.
באותה שעה התקינו שיהו חוזרין למקומן בכלי זיינן.
רב נחמן בר יצחק אמר לתרץ סתירת משנתנו, דקתני, שהיוצאין להציל חוזרין חוזרין למקומן, למשנה דראש השנה, דקתני, שאף הבא להציל אין לו אלא אלפיים אמה לכל רוח, לא קשיא:
כאן במשנה דראש השנה, מיירי שנצחו ישראל את אומות העולם, ואין להם לחוש מפני האויבים.
כאן במשנתנו, שנצחו אומות העולם את עצמן [כלומר: את ישראל] ויש לחוש שירדפו אחריהם, ולפיכך חוזרין למקומן.


MISHNAH. IF A MAN WHO WAS PERMITTED TO DO SO WENT OUT BEYOND THE SHABBOS LIMIT AND WAS THEN TOLD THAT THE ACT HAD ALREADY BEEN PERFORMED, HE IS ENTITLED TO MOVE WITHIN TWO THOUSAND CUBITS IN ANY DIRECTION. IF HE WAS WITHIN THE SHABBOS LIMIT HE IS REGARDED AS IF HE HAD NOT GONE OUT. ALL WHO GO OUT TO SAVE LIFE MAY GO BACK TO THEIR ORIGINAL PLACES.


 AND ALL WHO GO OUT TO SAVE LIFE MAY RETURN TO THEIR ORIGINAL PLACES. Even apparently where the distance was more [than two thousand cubits]. But was it not stated in the first clause, TWO THOUSAND CUBITS, and presumably no more? —

Rav Judah replied in the name of Rav: The meaning is that they MAY RETURN TO THEIR ORIGINAL PLACES with their weapons. But what [indeed] was the difficulty seeing that it is possible that the case of those who go to save lives is different? If a difficulty did at all exist it must have been the following. We learned: At first they did not stir from there all day but R. Gamaliel the Elder enacted that they shall be entitled to move within two thousand cubits in any direction. The enactment, moreover, was not applied to these only, but even a midwife who came to assist at a childbirth, or a man who came to rescue from an invading gang, from a river, from a ruin or from a fire is to be regarded as one of the people of the town and is entitled to move within two thousand cubits in any direction. Now [this evidently implies:] No more; but has it not been said: ALL WHO GO OUT TO SAVE LIFE MAY RETURN TO THE ORIGINAL PLACES even impliedly a larger distance? 

Rav Judah replied in the name of Rav: The meaning is that they MAY RETURN TO THEIR ORIGINAL PLACES with their weapons; as it was taught: At first they used to leave their weapons in a house that was nearest to the town wall. Once it happened that the enemies recognized them and pursued them, and as these entered the house to take up their weapons the enemies followed them. There was a stampede and the men who killed one another were more than those whom the enemies killed. At that time it was ordained that men in such circumstances shall return to their places with their weapons.

R. Nachman b. Yitzchak replied: There is really no contradiction: The latter deals with a case where the Jews overpowered the goyim while the former deals with one where the goyim overpowered themselves [i.e. the Jews]. 


So according to the conclusion of the gemara they may only go 2000 amos with their weapons because of the  מעשה שהיה [even though it means carrying the weapons] or may return home because the danger is still present since we lost the battle. But a doctor or the like would not be allowed to move outside of his 2000 amos [since he left his original techum]. Keep that in mind in the future:-). 

ZUGT the Rambam [Hilchos Shabbos 2/23]: 

עובדי כוכבים ומזלות שצרו על עיירות ישראל אם באו על עסקי ממון אין מחללין עליהן את השבת ואין עושין עמהן מלחמה. ובעיר הסמוכה לספר אפי' לא באו אלא על עסקי תבן וקש יוצאין עליהן בכלי זיין ומחללין עליהן את השבת. ובכל מקום אם באו על עסקי נפשות או שערכו מלחמה או שצרו סתם יוצאין עליהן בכלי זיין ומחללין עליהן את השבת. ומצוה על כל ישראל שיכולין לבוא ולצאת ולעזור לאחיהם שבמצור ולהצילם מיד העובדי כוכבים ומזלות בשבת. ואסור להן להתמהמה למוצאי שבת. וכשיצילו את אחיהן מותר להן לחזור בכלי זיין שלהן למקומם בשבת כדי שלא להכשילן לעתיד לבוא:



[The following rules apply] when gentiles lay siege to Jewish cities: If their intent was financial gain, the Shabbos laws should not be violated because of them, nor are we allowed to wage war against them. If a city is located near the border, however, we should march against them with weapons and wage war against them even when they are demanding hay or straw.

In any location, if the gentiles' intent was Jewish lives, or if they engaged in battle with a city or laid siege to it without stating a specific intention, we must wage war against them, and the Shabbos laws should be violated because of them. It is a mitzvah for every member of the Jewish people who can come [to their assistance] to go out and aid their brethren who are under siege and save them from the gentiles [although it is] Shabbos. It is forbidden to wait until Saturday night.

After they have saved their brethren, they may return home with their weapons on Shabbos in order not to cause them to stumble in the future.


Every seemed smooth [based on the rest of the suya there in Eiruvin] until we got to the end of the Rambam. The Rambam, predictably, לשיטתו, paskens .... not like the gemara:-)! The gemara says that we allow the soldiers to return 2000 amos with their weapons because of a certain event that occurred when people were killed because they weren't allowed to return with their weapons or they are allowed to return home because the danger is still imminent. But what is this story of "not causing them to stumble in the future - כדי שלא להכשילן לעתיד לבא" which means in other contexts that if we don't allow them this time, then next time they won't want to come out in the first place [see Rosh Hashana 21b]. In the words of the sefer יצחק ירנן:


ולכאורה קשה בדברי רבינו דלא פסק לא כתירוץ א' ולא כתירוץ ב' דאי פסק כתירוץ א' דחוזרין למקומן היינו בכלי זיינן א"כ לאיזה צורך כתב וכשיצילו את אחיהם וכו' אפילו שלא הצילו אלא שנצחו אומות העולם את עצמן חוזרין בכלי זיינן ואי פסק כרב נחמן בר יצחק דיש חילוק בין כשנצחו אומות העולם לכשנצחו ישראל א"כ איך קאמר סתם למקומן ומה גם דרבינו פסק בפירוש בפכ"ז כב' התירוצים וכמ"ש הרא"ש וכ"כ מרן בב"י סי' ת"ז יעו"ש.

The Rambam paskens like neither answer of the gemara and seems to make up his own??? And if we allow them to return home because otherwise next time they won't want to come in the first place - that would open the door to allowing doctors and hatzala people to return home after performing their emergency treatments whereas according to the gemara the heter to return home applies only to soldiers.
